Notes

machine translationAbū ʿĪsā said: This ḥadīth, we do not know it in this form except from the ḥadīth of Abū Ḥamzah al-Sukkarī. More than one narrator has reported this ḥadīth from ʿAbd al-ʿAzīz b. Rufayʿ, from Ibn Abī Mulaykah, from the Prophet ﷺ as a mursal report, and this is more authentic. Hannād narrated to us: Abū Bakr b. ʿAyyāsh narrated to us, from ʿAbd al-ʿAzīz b. Rufayʿ, from Ibn Abī Mulaykah, from the Prophet ﷺ, similar to it in meaning, and it does not contain "from Ibn ʿAbbās." Likewise more than one narrator reported it from ʿAbd al-ʿAzīz b. Rufayʿ like this, without "from Ibn ʿAbbās," and this is more authentic than the ḥadīth of Abū Ḥamzah. Abū Ḥamzah is trustworthy (thiqah); it is possible that the mistake came from someone other than Abū Ḥamzah. Hannād narrated to us: Abū al-Aḥwaṣ narrated to us, from ʿAbd al-ʿAzīz b. Rufayʿ, from Ibn Abī Mulaykah, from the Prophet ﷺ, similar to the ḥadīth of Abū Bakr b. ʿAyyāsh. Most of the people of knowledge said: preemption (shufʿah) applies only to houses and lands, and they did not hold that there is preemption in everything. Some of the people of knowledge said: preemption applies to everything. The first view is more authentic.
