machine translationAbū ʿĪsā said: This is a good and sound (ḥasan ṣaḥīḥ) hadith. Some of them have narrated it as a mursal report from Abū Salamah from the Prophet ﷺ. The practice is in accordance with this among some of the people of knowledge from the Companions of the Prophet ﷺ, among them ʿUmar b. al-Khaṭṭāb and ʿUthmān b. ʿAffān. Some of the jurists of the Successors also hold this view, such as ʿUmar b. ʿAbd al-ʿAzīz and others. It is the view of the people of Madinah, among them Yaḥyā b. Saʿīd al-Anṣārī, Rabīʿah b. Abī ʿAbd al-Raḥmān and Mālik b. Anas. Al-Shāfiʿī, Aḥmad and Isḥāq also hold this view. They do not recognize preemption (shufʿah) except for the co-owner (khalīṭ), and they do not recognize preemption for the neighbor if he is not a co-owner. Some of the people of knowledge from the Companions of the Prophet ﷺ and others said: Preemption is for the neighbor. They argued with the raised (marfūʿ) hadith from the Prophet ﷺ, who said: "The neighbor of the house has more right to the house," and he said: "The neighbor has more right to what is near him." This is the view of al-Thawrī, Ibn al-Mubārak and the people of Kūfah.

What scholars said about it

In their own words, as Hadith Unlocked records them. They are shown, not summarised into a grade.

  • Aḥmad b. Ḥanbal

رواية معمر عن الزهري في حديث الشفعة حسنة

machine translationMaʿmar's narration from al-Zuhrī in the ḥadīth on pre-emption (shufʿah) is good (ḥasan).

    in جامع الترمذي, p. 1438
  • Ibn ʿAbd al-Barr

حديث الزهري في الشفعة حديث صحيح معروف

machine translationAl-Zuhrī's ḥadīth on pre-emption (shufʿah) is a sound (ṣaḥīḥ) and well-known ḥadīth.

    in جامع الترمذي, p. 1438
  • Abū Ḥatim al-Rāzī

machine translationWhat I hold is that this much is the speech of the Prophet ﷺ: the Prophet ﷺ only established pre-emption (shufʿah) in what has not been divided at all. It seems that the rest of the statement is the speech of Jābir: "When it is divided and the boundaries have been set, there is no pre-emption." And God knows best.

    in جامع الترمذي, p. 1438
  • Dāraquṭnī

قول من قال عن أبي سلمة عن جابر فهو محفوظ أيضا

machine translationThe statement of the one who said "from Abū Salamah, from Jābir" is also preserved (maḥfūẓ).
