حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ ثنا أَبُو نُعَيْمٍ ثنا أَبُو شِهَابٍ مُوسَى بْنُ نَافِعٍ قَالَ
قَدِمْتُ مَكَّةَ وَأَنَا مُتَمَتِّعٌ بِعُمْرَةٍ فَقَدِمْنَا قَبْلَ التَّرْوِيَةِ بِثَلَاثَةِ أَيَّامٍ فَقَالَ لِي أَهْلُ مَكَّةَ تَصِيرُ الْآنَ حَجَّتُكَ مَكِّيَّةً فَدَخَلْتُ عَلَى عَطَاءِ بْنِ أَبِي رَبَاحٍ أَسْتَفْتِيهِ فَقَالَ حَدَّثَنِي جَابِرُ بْنُ عَبْدِ اللهِ أَنَّهُ حَجَّ مَعَ رَسُولِ اللهِ ﷺ يَوْمَ سَاقَ الْبُدْنَ وَقَدْ أَهَلُّوا بِالْحَجِّ مُفْرَدًا فَقَالَ لَهُمْ رَسُولُ اللهِ ﷺ «أَحِلُّوا مِنْ إِحْرَامِكُمْ بِطَوَافٍ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ وَأَقِيمُوا حَلَالًا حَتَّى إِذَا كَانَ يَوْمُ التَّرْوِيَةِ فَأَهِلُّوا بِالْحَجِّ وَاجْعَلُوا الَّذِي قَدِمْتُمْ بِهَا مُتْعَةً» قَالُوا كَيْفَ نَجْعَلُهَا مُتْعَةً وَقَدْ سَمَّيْنَا الْحَجَّ؟ فَقَالَ «افْعَلُوا مَا أَمَرْتُكُمْ فَلَوْلَا أَنِّي سُقْتُ الْهَدْيَ لَفَعَلْتُ مِثْلَ الَّذِي أَمَرْتُكُمْ وَلَكِنِّي لَا يَحِلُّ مِنِّي حَرَامٌ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ» فَفَعَلُوا وَلَمْ يَذْكُرْ قِصَّةَ سُرَاقَةَ بْنِ مَالِكٍ

✧ I arrived in Makkah performing tamattu' with an umrah. We arrived three days before al-Tarwiyah. The people of Makkah said to me, Your hajj will now become a Makkan one. So I went to Ata' b. Abi Rabah to seek his legal opinion. He said, Jabir b. Abd Allah narrated to me that he performed hajj with the Messenger of God ﷺ on the day he drove the budn, and they had entered ihram for hajj as individuals. The Messenger of God ﷺ said to them, "Exit your ihram by circumambulating the House and between al-Safa and al-Marwah, and remain halal until the day of al-Tarwiyah, then enter ihram for hajj. Make what you came with a mut'ah." They said, How can we make it a mut'ah when we have already named it hajj? He said, "Do what I commanded you. Had I not driven the sacrificial animal, I would have done the same as what I commanded you. But no forbidden thing becomes lawful for me until the sacrificial animal reaches its place of sacrifice." So they did it. He did not mention the story of Suraqah b. Malik.
