حَدَّثَنَا مُوسَى بْنُ هَارُونَ ثنا دَاوُدُ بْنُ عَمْرٍو الضَّبِّيُّ ثنا مُحَمَّدُ بْنُ مُسْلِمٍ عَنْ عَمْرِو بْنِ دِينَارٍ قَالَ سَمِعْتُ الْحَسَنَ بْنَ أَبِي الْحَسَنِ عَنْ سَلَمَةَ بْنِ رَبِيعَةَ بْنِ الْمُحَبِّقِ قَالَ
سَمِعْتُ امْرَأَةً تَسْأَلُ رَسُولَ اللَّهِ ﷺ عَنْ جَارِيَةٍ لَهَا، خَرَجَ بِهَا زَوْجُهَا إِلَى سَفَرٍ فَأَصَابَهَا، فَقَالَ رَسُولُ اللَّهِ ﷺ: «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ، وَعَلَيْهِ مِثْلُهَا، وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ جَارِيَتُهُ، وَعَلَيْهِ مِثْلُهَا».

✧ I heard a woman ask the Messenger of Allah ﷺ about a slave-girl she owned: her husband had taken her with him on a journey and had intercourse with her. The Messenger of Allah ﷺ said: “If he compelled her, then she is free, and he owes one like her; but if she consented to him, then she is his slave-girl, and he owes one like her.”
