حَدَّثَنَا أَبُو خَلِيفَةَ ثنا عَلِيُّ بْنُ الْمَدِينِيِّ ثنا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنِ الْحَسَنِ الْبَصْرِيِّ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ أَنَّ رَجُلًا أَتَى جَارِيَةَ امْرَأَتِهِ
وَأَنَّ ذَلِكَ رُفِعَ إِلَى النَّبِيِّ ﷺ فَقَالَ «إِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَةٌ وَلَهَا مِثْلُهَا يَعْنِي لِسَيِّدَتِهَا وَإِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَلِسَيَّدَتِهَا مِثْلُهَا» قَالَ عَلِيٌّ فَقُلْتُ لِسُفْيَانَ فَإِنَّ قَتَادَةَ يَقُولُ عَنِ الْحَسَنِ عَنْ قَبِيصَةَ بْنِ حُرَيْثٍ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ فَقَالَ سُفْيَانُ قَالَ عَمْرٌو بَيْنَهُمَا إِنْسَانٌ أَوْ رَجُلٌ فَقَالَ لَهُ الْهُذَلِيُّ يَعْنِي أَبَا بَكْرٍ الْهُذَلِيَّ بَيْنَهُمَا قَبِيصَةُ بْنُ حُرَيْثٍ قَالَ سُفْيَانُ وَإِنَّمَا أَعْرِفُ هَذَا الْهُذَلِيَّ إِنَّهُ مِنْ قَوْمِ سَلَمَةَ

✧ And that was brought to the Prophet ﷺ, and he said: "If she consented, then she is a slave woman, and her mistress is owed a similar one; and if he forced her, then she is free, and her mistress is owed a similar one." ʿAlī said: I said to Sufyān: "Qatādah says, on the authority of al-Ḥasan, from Qabīṣah b. Ḥurayth, from Salamah b. al-Muḥabbiq." Sufyān said: "ʿAmr said: Between the two of them there is a person, or a man." Al-Hudhalī — meaning Abū Bakr al-Hudhalī — said to him: "Between the two of them is Qabīṣah b. Ḥurayth." Sufyān said: "I only know that this al-Hudhalī is from Salamah's people."
