حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ عَنْ عَبْدِ الرَّزَّاقِ عَنْ مَعْمَرٍ عَنْ قَتَادَةَ عَنِ الْحَسَنِ عَنْ قَبِيصَةَ بْنِ حُرَيْثٍ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ قَالَ
قَضَى رَسُولُ اللهِ ﷺ فِي رَجُلٍ وَطَأَ جَارِيَةَ امْرَأَتَهِ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ أَمَةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا»

✧ The Messenger of Allah ﷺ ruled regarding a man who had intercourse with his wife's slave woman: "If he forced her, then she is free, and he owes her mistress a similar one; and if she consented, then she is his slave woman, and he owes her mistress a similar one."
