حَدَّثَنَا عَلِيُّ بْنُ سَعِيدٍ الرَّازِيُّ ثنا مُحَمَّدُ بْنُ حُمَيْدٍ ثنا سَلَمَةُ بْنُ الْفَضْلِ ثنا ابْنُ إِسْحَاقَ عَنِ الْخَطَّابِ بْنِ صَالِحٍ عَنْ أُمِّهِ عَنْ سَلَامَةَ بِنْتِ مَعْقِلٍ قَالَتْ كُنْتُ لِلْحُبَابِ بْنِ عَمْرٍو فَمَاتَ وَلِي مِنْهُ وَلَدٌ
فَقَالَتِ امْرَأَتُهُ الْآنَ تُبَاعِينَ فِي دَيْنِهِ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «وَمَنْ صَاحِبُ تَرِكَةِ الْحُبَابِ؟» فَقَالَ أَخُوهُ أَبُو الْيَسَرِ كَعْبُ بْنُ عَمْرٍو فَدَعَاهُ النَّبِيُّ ﷺ فَقَالَ «لَا تَبِيعُوهَا وَأَعْتِقُوهَا وَإِذَا سَمِعْتُمْ بِرَقِيقٍ قَدْ جَاءَنِي فَأْتُونِي أُعَوِّضْكُمْ» فَفَعَلُوا مَا اخْتَلَفُوا فِيمَا بَيْنَهُمْ بَعْدَ وَفَاةِ رَسُولِ اللهِ ﷺ فَقَالُوا أُمُّ الْوَلَدِ مَمْلُوكَةٌ لَوْلَا ذَلِكَ لَمْ يُعَوِّضْهُمُ النَّبِيُّ ﷺ وَقَالَ بَعْضُهُمْ هِيَ حُرَّةٌ قَدْ أَعْتَقَهَا النَّبِيُّ ﷺ

✧ His wife said: Now you will be sold on account of his debt. So I came to the Messenger of God ﷺ and mentioned that to him. He said: “Who is the one responsible for the estate of al-Hubab?” His brother Abu al-Yasar Ka‘b b. ‘Amr said: I am. The Prophet ﷺ called him and said: “Do not sell her; set her free. When you hear of slaves that have come to me, come to me and I will compensate you.” They did so. Then they differed among themselves after the death of the Messenger of God ﷺ. Some said: An umm walad is owned as a slave; were it not for that, the Prophet ﷺ would not have compensated them. Others said: She is free; the Prophet ﷺ had set her free.
