حَدَّثَنَا أَحْمَدُ بْنُ يَحْيَى الْحُلْوَانِيُّ ثنا سَعِيدُ بْنُ سُلَيْمَانَ عَنْ يَزِيدَ بْنِ عَطَاءٍ عَنْ سِمَاكٍ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيهِ قَالَ

جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّ هَذَا قَتَلَ أَخِي يَا رَسُولَ اللهِ قَالَ «كَيْفَ قَتَلْتَهُ؟» قَالَ ضَرَبْتُ رَأْسَهُ بِالْفَأْسِ وَلَمْ أُرِدْ قَتْلَهُ قَالَ «هَلْ لَكَ مَالٌ تُؤَدِّي دِيَّتَهُ» قَالَ لَا فَقَالَ النَّبِيُّ ﷺ لِلرَّجُلِ «خُذْهُ» فَخَرَجَ بِهِ لِيَقْتُلَهُ فَقَالَ النَّبِيُّ ﷺ «إِنْ قَتَلَهُ كَانَ مِثْلَهُ» فَرَجَعَ بِهِ حِينَ سَمِعَ قَوْلَهُ فَقَالَ هُوَ هَذَا فَأَمُرْ بِهِ مَا شِئْتَ فَقَالَ النَّبِيُّ ﷺ «أَرْسِلْهُ»

✧ A man came to the Prophet ﷺ and said, “This man killed my brother, O Messenger of God.” He said, “How did you kill him?” He said, “I struck his head with an axe, and I did not intend to kill him.” He said, “Do you have wealth with which to pay his blood money?” He said, “No.” The Prophet ﷺ said to the man, “Take him.” So he went out with him to kill him, but the Prophet ﷺ said, “If he kills him, he will be like him.” The man brought him back when he heard his words and said, “Here he is, so order concerning him whatever you wish.” The Prophet ﷺ said, “Let him go.”
