حَدَّثَنَا أَحْمَدُ بْنُ زُهَيْرٍ التُّسْتَرِيُّ ثنا مُحَمَّدُ بْنُ بَشَّارٍ بُنْدَارٍ ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَنْصَارِيُّ ثنا أَبُو يُونُسَ الْقُشَيْرِيُّ ثنا سِمَاكُ بْنُ حَرْبٍ أَنَّ عَلْقَمَةَ بْنَ وَائِلٍ حَدَّثَهُ عَنْ أَبِيهِ قَالَ

بَيْنَمَا أَنَا عِنْدَ النَّبِيِّ ﷺ إِذْ دَخَلَ رَجُلٌ يَقُودُ رَجُلًا بِنِسْعَةٍ حَتَّى أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ هَذَا قَتَلَ أَخِي قَالَ «أَقَتَلْتَهُ؟» قَالَ نَعَمْ قَالَ «كَيْفَ قَتَلْتَهُ؟» قَالَ كُنَّا نَحْتَطِبُ مِنْ شَجَرَةٍ فَسَبَّنِي فَضَرَبْتُهُ بِالْفَأْسِ عَلَى قَرْنِهِ فَقَتَلْتُهُ فَقَالَ «عِنْدَكَ مَالٌ تَدِيهِ عَنْ نَفْسِكَ» قَالَ لَا وَاللهِ مَا لِي مَالٌ إِلَّا فَأْسِي وَكِسَائِي قَالَ «أَتَرَى قَوْمَكَ يَدُونَكَ؟» قَالَ أَنَا أَهْوَنُ عَلَى قَوْمِي مِنْ ذَاكَ فَرَمَى بِنِسْعَتِهِ إِلَيْهِ فَقَالَ «دُونَكَ صَاحِبَكَ» فَلَمَّا وَلَّى قَالَ رَسُولُ اللهِ ﷺ «إِنْ قَتَلَهُ فَهُوَ مِثْلُهُ» فَأَتَاهُ آتٍ فَقَالَ وَيْلَكَ إِنَّ رَسُولَ اللهِ ﷺ يَقُولُ «إِنْ قَتَلَهُ فَهُوَ مِثْلَهُ» قَالَ يَا رَسُولَ اللهِ مَا أَخَذْتُهُ إِلَّا بِأَمْرِكَ فَقَالَ «أَمَا تُرِيدُ أَنْ يَبُوءَ بِإِثْمِهِ وَإِثْمَ صَاحِبِكَ» قَالَ بَلَى يَا رَسُولَ اللهِ قَالَ «فَإِنَّهُ كَذَلِكَ» فَرَمَى نِسْعَتَهُ وَقَالَ «اذْهَبْ حَيْثُ شِئْتَ»

✧ While I was with the Prophet ﷺ, a man entered leading another man by a rope until he came to the Messenger of God ﷺ and said, “O Messenger of God, this man killed my brother.” He said, “Did you kill him?” He said, “Yes.” He said, “How did you kill him?” He said, “We were gathering firewood from a tree, and he insulted me, so I struck him with an axe on the side of his head and killed him.” He said, “Do you have wealth with which to pay for yourself?” He said, “No, by God, I have no wealth except my axe and my cloak.” He said, “Do you think your people will pay on your behalf?” He said, “I am less important to my people than that.” So the man threw his rope to him and said, “Take charge of your companion.” When he turned away, the Messenger of God ﷺ said, “If he kills him, he is like him.” A man came to him and said, “Woe to you! The Messenger of God ﷺ says, ‘If he kills him, he is like him.’” He said, “O Messenger of God, I did not take him except by your command.” He said, “Do you not want him to bear his sin and the sin of your companion?” He said, “Yes, O Messenger of God.” He said, “Then it is so.” He threw his rope and said, “Go wherever you wish.”
