ثَنَا الْقَعْنَبِيُّ عَنْ مَالِكٍ ح وَحَدَّثَنَا أَبُو يَزِيدَ القَرَاطِيسِيُّ ثَنَا عَبْدُ اللهِ بْنُ عَبْدِ الْحَكَمِ ح وَحَدَّثَنَا بَكْرُ بْنُ سَهْلٍ ثَنَا عَبْدُ اللهِ بْنُ يُوسُفَ ح وَحَدَّثَنَا يُوسُفُ الْقَاضِي ثَنَا عَمْرُو بْنُ مَرْزُوقٍ قَالُوا أَنَا مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ عُثْمَانَ بْنِ إِسْحَاقَ بْنِ خَرَشَةَ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ قَالَ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ ؓ تَسْأَلُهُ مِيرَاثَهَا فِي كِتَابِ اللهِ فَقَالَ لَهَا أَبُو بَكْرٍ مَا لَكِ فِي كِتَابِ اللهِ شَيْءٌ وَمَا عَلِمْتُ لَكِ فِي سُنَّةِ رَسُولِ اللهِ ﷺ شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ فَسَأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ «حَضَرَتُ رَسُولَ اللهِ ﷺ فَأَعْطَاهَا السُّدُسَ» فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ الْأَنْصَارِيُّ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ ثُمّ جَاءَتِ الْجَدَّةُ الْأُخْرَى إِلَى عُمَرَ بْنِ الْخَطَّابِ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللهِ مِنْ شَيْءٍ وَمَا كَانَ الْقَضَاءُ الَّذِي قُضِيَ بِهِ إِلَّا لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ شَيْئًا وَلَكِنْ هُوَ ذَلِكَ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا وَاللَّفْظُ لِحَدِيثِ ابْنِ عَبْدِ الْحَكَمِ

✧ Al-Qa'nabi narrated to us from Malik. H. And Abu Yazid al-Qaratisi narrated to us: Abdullah b. Abd al-Hakam narrated to us. H. And Bakr b. Sahl narrated to us: Abdullah b. Yusuf narrated to us. H. And Yusuf al-Qadi narrated to us: Amr b. Marzuq narrated to us. They said: Malik reported to us, from Ibn Shihab, from Uthman b. Ishaq b. Kharashah, from Qabisah b. Dhu'ayb, who said: A grandmother came to Abu Bakr al-Siddiq ؓ asking him about her inheritance in the Book of Allah. Abu Bakr said to her: "You have nothing in the Book of Allah, and I do not know of anything for you in the Sunnah of the Messenger of Allah ﷺ, so go back until I ask the people." He asked the people, and al-Mughirah b. Shu'bah said: "I was present with the Messenger of Allah ﷺ and he gave her a sixth." Abu Bakr said: "Is there anyone else with you?" Muhammad b. Maslamah al-Ansari stood up and said the like of what al-Mughirah said, so Abu Bakr carried it out for her. Then the other grandmother came to Umar b. al-Khattab asking him about her inheritance. He said: "You have nothing in the Book of Allah, and the ruling that was given was only for someone other than you, and I am not going to add anything to the fixed shares, but it is that sixth, so if you both come together, it is between you, and whichever of you is alone with it, it is hers." The wording is that of the hadith of Ibn Abd al-Hakam.
