حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ أَنَا عَبْدُ الرَّزَّاقِ أَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ قَالَ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ ؓ تَطْلُبُ مِيرَاثَهَا مِنِ ابْنِ ابْنِهَا أَوِ ابْنِ ابْنَتِهَا لَا أَدْرِي أَيَّتَهُمَا هِيَ فَقَالَ
أَبُو بَكْرٍ مَا أَجِدُ لَكِ فِي كِتَابِ اللهِ شَيْئًا وَمَا سَمِعْتُ رَسُولَ اللهِ ﷺ يَقْضِي لَكِ بِشَيْءٍ وَسَأَسْأَلُ النَّاسَ الْعَشِيَّةَ فَلَمَّا صَلَّى الظُّهْرَ أَقْبَلَ عَلَى النَّاسِ فَقَالَ إِنَّ الْجَدَّةَ أَتَتْنِي تَسْأَلُنِي مِيرَاثَهَا مِنِ ابْنِ ابْنِهَا أَوِ ابْنِ ابْنَتِهَا وَإِنِّي لَمْ أَجِدْ لَهَا فِي الْكِتَابِ شَيْئًا وَلَمْ أَسْمَعِ النَّبِيَّ ﷺ قَضَى لَهَا بِشَيْءٍ فَهَلْ سَمِعَ أَحَدٌ مِنْكُمْ مِنْ رَسُولِ اللهِ ﷺ فِيهَا شَيْئًا؟ فَقَامَ الْمُغِيرَةُ بْنُ شُعْبَةَ فَقَالَ «شَهِدْتُ رَسُولَ اللهِ ﷺ يَقْضِي لَهَا بِالسُّدُسِ» فَقَالَ هَلْ سَمِعَ ذَلِكَ مَعَكَ أَحَدٌ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ فَقَالَ «شَهِدْتُ رَسُولَ اللهِ ﷺ يَقْضِي لَهَا بِالسُّدُسِ» فَأَعْطَاهَا أَبُو بَكْرٍ السُّدُسَ فَلَمَّا كَانَتْ خِلَافَةُ عُمَرَ جَاءَتْهُ الْجَدَّةُ الَّتِي تُخَالِفُهَا فَقَالَ عُمَرُ ؓ إِنَّمَا كَانَ الْقَضَاءُ فِي غَيْرِكِ وَلَكِنْ إِذَا اجْتَمَعْتُمَا فَالسُّدُسُ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا

✧ Abu Bakr said: "I do not find anything for you in the Book of Allah, and I have not heard the Messenger of Allah ﷺ give a ruling for you in anything. I will ask the people this evening." When he prayed Zuhr, he turned to the people and said: "A grandmother has come to me asking about her inheritance from her grandson or her granddaughter's son, and I have not found anything for her in the Book, nor have I heard the Prophet ﷺ rule anything for her. Has any of you heard anything from the Messenger of Allah ﷺ concerning her?" Al-Mughirah b. Shu'bah stood up and said: "I bear witness that the Messenger of Allah ﷺ gave her a sixth." He said: "Did anyone hear that with you?" Muhammad b. Maslamah stood up and said: "I bear witness that the Messenger of Allah ﷺ gave her a sixth." So Abu Bakr gave her a sixth. When it was the caliphate of Umar, the other grandmother came to him. Umar ؓ said: "The ruling was only for someone other than you, but if you both come together, then the sixth is between you, and whichever of you is alone with it, it is hers."
