حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَضْرَمِيُّ وَعَبْدَانُ بْنُ أَحْمَدَ قَالَا ثنا تَمِيمُ بْنُ الْمُنْتَصِرِ ثنا إِسْحَاقُ الْأَزْرَقُ عَنْ شَرِيكٍ عَنْ سِمَاكٍ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ
اشْتَرَتْ عَائِشَةُ بَرِيرَةَ مِنَ الْأَنْصَارِ لِتُعْتِقَهَا وَاشْتَرَطُوا عَلَيْهَا وَلَاءَهَا فَشَرَطَتْ لَهُمْ ذَلِكَ فَلَمَّا جَاءَ النَّبِيُّ ﷺ أَخْبَرَتْهُ فَقَالَ «إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» ثُمَّ صَعِدَ الْمِنْبَرَ فَقَالَ «مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللهِ مَا كَانَ شَرْطًا لَيْسَ فِي كِتَابِ اللهِ فَمَرْدُودٌ إِلَى كِتَابِ اللهِ» وَكَانَ لِبَرِيرَةَ زَوْجٌ فَخَيَّرَهَا رَسُولُ اللهِ ﷺ إِنْ شَاءَتْ أَنْ تَمْكُثَ مَعَ زَوْجِهَا كَمَا هِيَ وَإِنْ شَاءَتْ فَارَقَتْهُ فَفَارَقَتْهُ فَدَخَلَ النَّبِيُّ ﷺ فَرَأَى رِجْلَ شَاةٍ فَقَالَ لِعَائِشَةَ «أَلَا تَطْبُخِي لَنَا هَذَا اللَّحْمَ؟» قَالَتْ تُصِدِّقَ بِهِ عَلَى بَرِيرَةَ فَأَهْدَتْهُ لَنَا قَالَ «اطْبُخُوهُ فَهُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ»

✧ ʿAʾishah bought Barīrah from the Ansar to set her free, and they stipulated her walaʾ for themselves. She granted them that. When the Prophet ﷺ came, she informed him, and he said, “Walaʾ is only for the one who sets free.” Then he ascended the pulpit and said, “What is the matter with people who stipulate conditions not in the Book of Allah? Any condition not in the Book of Allah is rejected, even if it is a hundred conditions.” Barīrah had a husband, and the Messenger of Allah ﷺ gave her the choice: if she wished, she could remain with her husband as she was, and if she wished, she could separate from him. She separated from him. Then the Prophet ﷺ entered and saw a leg of a sheep and said to ʿAʾishah, “Will you not cook this meat for us?” She said, “It was given as charity to Barīrah, and she gave it to us as a gift.” He said, “Cook it, for it is charity for her and a gift for us.”
