أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ عَنْ مُحَمَّدٍ يَعْنِي غُنْدَرًا عَنْ شُعْبَةَ عَنْ عَاصِمٍ عَنِ الشَّعْبِيِّ قَالَ سُئِلَ عَبْدُ اللهِ

عَنِ امْرَأَةٍ تُوُفِّيَ عَنْهَا زَوْجُهَا وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا فَقَالَ ابْنُ مَسْعُودٍ سَلِ النَّاسَ فَإِنَّ النَّاسَ كَثِيرٌ أَوْ كَمَا قَالَ فَقَالَ الرَّجُلُ وَاللهِ لَوْ مَكَثْتُ حَوْلًا مَا سَأَلْتُ غَيْرَكَ قَالَ فَرَّدَدَهُ ابْنُ مَسْعُودٍ شَهْرًا ثُمَّ قَامَ فَتَوَضَّأَ ثُمَّ رَكَعَ رَكْعَتَيْنِ ثُمَّ قَالَ اللهُمَّ مَا كَانَ مِنْ صَوَابٍ فَمِنْكَ وَمَا كَانَ مِنْ خَطَأٍ فَمِنِّي ثُمَّ قَالَ أَرَى لَهَا صَدَاقَ إِحْدَى نِسَائِهَا وَلَهَا الْمِيرَاثُ مَعَ ذَلِكَ وَعَلَيْهَا الْعِدَّةُ فَقَامَ رَجُلٌ مِنْ أَشْجَعَ فَقَالَ قَضَى فِينَا رَسُولُ اللهِ ﷺ بِمِثْلِ ذَلِكَ فِي امْرَأَةٍ مِنَّا يُقَالُ لَهَا بَرْوَعُ بِنْتُ وَاشِقٍ فَقَالَ ابْنُ مَسْعُودٍ هَلْ مَعَكَ أَحَدٌ؟ فَقَامَ أُنَاسٌ مِنْهُمْ فَشَهِدُوا [225] 5497 أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللهِ بْنِ الْحَكَمِ الْبَصْرِيُّ عَنْ مُحَمَّدِ بْنِ جَعْفَرٍ عَنْ شُعْبَةَ عَنْ سَيَّارٍ عَنِ الشَّعْبِيِّ قَالَ اخْتُلِفَ إِلَى عَبْدِ اللهِ شَهْرًا فِي رَجُلٍ مَاتَ وَلَمْ يَفْرِضْ لِامْرَأَتِهِ صَدَاقًا فَذَكَرَهُ وَفِيهِ فَقَامَ مَعْقِلُ بْنُ سِنَانٍ فَقَالَ قَضَى رَسُولُ اللهِ ﷺ فِي بَرْوَعَ بِنْتِ وَاشِقٍ مِثْلَ هَذَا 5498 أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ الرُّهَاوِيُّ عَنْ يَعْلَى هُوَ ابْنُ عُبَيْدٍ عَنْ إِسْمَاعِيلَ هُوَ ابْنُ أَبِي خَالِدٍ عَنْ عَامِرٍ يَعْنِي الشَّعْبِيَّ قَالَ أُتِيَ ابْنُ مَسْعُودٍ فِي امْرَأَةٍ مَاتَ زَوْجُهَا وَلَمْ يَفْرِضْ لَهَا وَسَاقَ الْحَدِيثَ قَالَ فَقَالَ مَعْقِلُ بْنُ سِنَانٍ قَضَى رَسُولُ اللهِ ﷺ فِي بَرْوَعَ بِنْتِ وَاشِقٍ مِثْلَ هَذَا

✧ About a woman whose husband died without consummating the marriage and without specifying a dower for her. Ibn Mas'ud said: 'Ask the people, for the people are many,' or as he said. The man said: 'By Allah, even if I stayed for a year, I would not ask anyone but you.' He said: Ibn Mas'ud kept him coming back for a month, then he stood up, performed ablution, prayed two rak'ahs, then said: 'O Allah, whatever is correct is from You, and whatever is wrong is from me.' Then he said: 'I hold that she should have a dower like that of her peers, and she inherits along with that, and she must observe the waiting period.' Then a man from Ashja' stood up and said: 'The Messenger of Allah ﷺ ruled among us something similar regarding a woman of ours called Barwa' bt. Washiq.' Ibn Mas'ud said: 'Is there anyone with you?' Then some people among them stood up and testified. [225] 5497 Ahmad b. Abdullah b. al-Hakam al-Basri informed us, from Muhammad b. Ja'far, from Shu'bah, from Sayyar, from al-Sha'bi, who said: Dispute was brought to Abdullah for a month concerning a man who died without specifying a dower for his wife, and he mentioned it, and in it: Ma'qil b. Sinan stood up and said: 'The Messenger of Allah ﷺ ruled in the case of Barwa' bt. Washiq the like of this.' 5498 Ahmad b. Sulayman al-Ruhawi informed us, from Ya'la, i.e., Ibn Ubayd, from Isma'il, i.e., Ibn Abi Khalid, from Amir, i.e., al-Sha'bi, who said: Ibn Mas'ud was consulted about a woman whose husband died without specifying a dower for her, and he narrated the hadith. He said: Then Ma'qil b. Sinan said: 'The Messenger of Allah ﷺ ruled in the case of Barwa' bt. Washiq the like of this.'
