✧ I was with Umar ؓ when it was said to him: 'Zayd b. Thabit ؓ is giving legal opinions to the people in the mosque—Zuhair said in his hadith: to the people according to his own opinion—concerning one who has intercourse without ejaculating.' He said: 'Bring him quickly.' So he was brought. Umar said: 'O enemy of yourself! Have you reached the point of giving legal opinions to the people in the mosque of the Messenger of Allah ﷺ according to your own opinion?' He said: 'I did not do that. My paternal uncles narrated to me from the Messenger of Allah ﷺ.' He said: 'Which of your paternal uncles?' He said: 'Ubayy b. Ka'b.' Zuhair said: 'And Abu Ayyub and Rifa'ah b. Rafi'.' Umar ؓ turned to me and said: 'What does this young man say?' I said: 'We used to do it in the time of the Messenger of Allah ﷺ.' He said: 'Did you ask the Messenger of Allah ﷺ about it?' He said: 'We used to do it in the time of the Messenger of Allah ﷺ.' He said: So he gathered the people, and they agreed that water is only required from water, except for two men: Ali b. Abi Talib and Mu'adh b. Jabal ؓ, who said: 'When the circumcised part passes the circumcised part, ghusl becomes obligatory.' He said: Ali ؓ then said: 'O Commander of the Believers, the most knowledgeable of people about this are the wives of the Prophet ﷺ.' So he sent to Hafsah ؓ, and she said: 'I have no knowledge.' Then he sent to Aishah ؓ, and she said: 'When the circumcised part passes the circumcised part, ghusl becomes obligatory.' Then Umar ؓ became enraged and said: 'Let it not reach me that anyone did it without performing ghusl, or I will punish him severely.'
