أَبُو يَعْلَى: حَدَّثَنَا أَبُو الْحَكَمِ مِسْجَعُ بْنُ مُصْعَبٍ، ثَنَا يُونُسُ بْنُ أَرْقَمَ، ثَنَا أَبُو الْجَارُودِ، عَنْ حَبِيبِ بْنِ يَسَارٍ، عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ:

كَانَ الْعَبَّاسُ بْنُ عَبْدِ الْمُطَّلِبِ ؓ إِذَا دَفَعَ مَالًا مُضَارَبَةً اشْتَرَطَ عَلَى صَاحِبِهِ أَلَّا يَسِيرَ بَرًّا وَلَا بَحْرًا، وَلَا يَنْزِلَ بِهِ وَادِيًا، وَلَا يَشْتَرِيَ بِهِ ذَاتَ كَبِدٍ رَطْبَةٍ، فَإِذَا فَعَلَ ذَلِكَ فَهُوَ ضَامِنٌ، فَرَفَعَ شَرْطَهُ إِلَى النَّبِيِّ ﷺ فَأَجَازَهُ

Translation

✧ Al-'Abbas b. 'Abd al-Muttalib ؓ, when he gave money as a speculative partnership, stipulated upon his partner that he should not travel by land or by sea, nor descend into a valley with it, nor buy with it an animal with a wet liver (i.e., livestock). If he did that, he would be liable. His condition was brought to the Prophet ﷺ and he approved it.
