Their return to the Prophet ﷺ regarding the ruling of stoning
[ ظُلْمُهُمْ فِي الدِّيَةِ ] قَالَ ابْنُ إسْحَاقَ: وَحَدَّثَنِي داوُدَ بْنُ الْحُصَيْنِ عَنْ عِكْرِمَةَ، عَنْ ابْنِ عَبَّاسٍ: أَنَّ الْآيَاتِ مِنْ الْمَائِدَةِ الَّتِي قَالَ اللَّهُ فِيهَا: فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ وَإِنْ تُعْرِضْ عَنْهُمْ فَلَنْ يَضُرُّوكَ شَيْئًا وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ إنَّمَا أُنْزِلَتْ فِي الدِّيَةِ بَيْنَ بَنِي النَّضِيرِ وَبَيْنَ بَنِي قُرَيْظَةَ، وَذَلِكَ أَنَّ قَتْلَى بَنِي النَّضِيرِ، وَكَانَ لَهُمْ شَرَفٌ، يُؤَدُّونَ الدِّيَةَ كَامِلَةً، وَأَنَّ بَنِي قُرَيْظَةَ ( كَانُوا ) يُؤَدُّونَ نِصْفَ الدِّيَةِ، فَتَحَاكَمُوا فِي ذَلِكَ إلَى رَسُولِ اللَّهِ ﷺ، فَأَنْزَلَ اللَّهُ ذَلِكَ فِيهِمْ، فَحَمَلَهُمْ رَسُولُ اللَّهِ ﷺ عَلَى الْحَقِّ فِي ذَلِكَ، فَجَعَلَ الدِّيَةَ سَوَاءً. قَالَ ابْنُ إسْحَاقَ: فَاَللَّهُ أَعْلَمُ أَيُّ ذَلِكَ كَانَ
Translation
✧ [Their injustice in the blood-money] Ibn Isḥāq said: Dāwūd b. al-Ḥuṣayn narrated to me, from ʿIkrimah, from Ibn ʿAbbās: The verses of al-Māʾidah in which God said: “So judge between them or turn away from them. If you turn away from them, they will not harm you in anything. But if you judge, judge between them with justice. Indeed, God loves those who act justly” were only sent down concerning the blood-money between the Banū al-Naḍīr and the Banū Qurayẓah. That is because the slain of the Banū al-Naḍīr—and they had nobility—were paid the full blood-money, while the Banū Qurayẓah were paid half the blood-money. They took their dispute over that to the Messenger of God ﷺ, and God sent down that regarding them. The Messenger of God ﷺ made them adhere to the truth in that matter and made the blood-money equal. Ibn Isḥāq said: God knows best which of those it was.
