Quraysh's Innovation of the Hums

ابْتِدَاعُ قُرَيْشٍ الْحَمْسَ وَالْحَمْسُ رَأْيٌ ارْتَأَتْهُ قُرَيْشٌ إِذْ قَالَتْ أَنَّهُمْ هُمْ قُطَّانُ الْحَرَمِ وَبَنُو إِبْرَاهِيمَ وَوُلَاةُ الْبَيْتِ فَلَا يَنْبَغِي أَنْ نَكُونَ كَغَيْرِنَا فَيَجِبُ أَلَّا نُعَظِّمَ شَيْئًا مِنَ الْحِلِّ كَتَعْظِيمِنَا لِلْحَرَمِ، وَمِنْ ثَمَّ تَرَكُوا الْوُقُوفَ بِعَرَفَةَ وَالْإِفَاضَةَ مِنْهَا مَعَ كَوْنِهِمْ يُقِرُّونَ بِأَنَّهَا مِنَ الْمَنَاسِكِ إِلَّا أَنَّهُمْ رَأَوْا أَنْ يَكُونَ ذَلِكَ لِغَيْرِهِمْ. وَجَعَلُوا الْحَمْسَ أَهْلَ الْحَرَمِ يَنْسُبُ لَهَا كُلُّ مَنْ وُلِدَ مِنَ الْعَرَبِ فِيهَا مِنْ سَاكِنِ الْحِلِّ أَوِ الْحَرَمِ. وَدَانَتْ بَعْضُ الْقَبَائِلِ مَعَ قُرَيْشٍ بِالْحَمْسِ، وَلَمْ يَقِفِ الْأَمْرُ عِنْدَ ذَلِكَ بَلِ ابْتَدَعُوا بَعْدَ ذَلِكَ وَزَادُوا فِي هَذَا الْأَمْرِ فَلَا يَأْتَقِطُوا الْأَقِطَ وَلَا يَدْخُلُوا بَيْتًا مِنَ الشَّعْرِ وَلَا يَسْتَظِلُّوا إِذَا أَرَادُوا إِلَّا فِي بُيُوتٍ مِنْ أَدَمٍ مَا كَانُوا حَرَمًا إِلَى غَيْرِ ذَلِكَ مِنَ الْبِدَعِ. فَجَاءَ اللَّهُ سُبْحَانَهُ بِالْإِسْلَامِ فَأُبْطِلُ مَا ابْتَدَعَتْهُ قُرَيْشًا وَلِلَّهِ الْحَمْدُ.

Translation

✧ Quraysh's Innovation of the Hums The hums was an opinion that Quraysh adopted when they said that they are the inhabitants of the sanctuary, the sons of Ibrahim, and the custodians of the House; therefore it is not fitting that we should be like others, and so we must not venerate anything of the profane land as we venerate the sanctuary. Hence, they abandoned standing at ʿArafah and the ifāḍah from it, even though they acknowledged that it is among the rites, except that they held that this should be for others besides them. They made the hums the people of the sanctuary, to whom every Arab born in it was affiliated, whether from the dwellers of the profane land or the sanctuary. Some tribes adopted the hums together with Quraysh, and the matter did not stop there; rather, they innovated after that and added to this matter, so they would not make aqit (dried curd), nor enter a tent of hair, nor seek shade, when they intended to, except in dwellings of tanned leather, as long as they were in the state of iḥrām, in addition to other innovations. Then Allah, glorified be He, brought Islam and abolished what Quraysh had innovated. And praise be to Allah.
