إِيقَاعِ الْحَكَمِ بِأَهْلِ قُرْطُبَةَ كَانَ الْحَكَمُ فِي صَدْرِ وِلَايَتِهِ تَظَاهَرَ بِشُرْبِ الْخَمْرِ وَالِانْهِمَاكِ فِي اللَّذَّاتِ، وَكَانَتْ قُرْطُبَةُ دَارَ عِلْمٍ، وَبِهَا فُضَلَاءُ فِي الْعِلْمِ وَالْوَرَعِ، مِنْهُمْ: يَحْيَى بْنُ يَحْيَى اللَّيْثِيُّ، رَاوِي مُوَطَّأِ مَالِكٍ عَنْهُ، وَغَيْرُهُ، فَثَارَ أَهْلُ قُرْطُبَةَ، وَأَنْكَرُوا فِعْلَهُ، وَرَجَمُوهُ بِالْحِجَارَةِ، وَأَرَادُوا قَتْلَهُ، فَامْتَنَعَ مِنْهُمْ بِمَنْ حَضَرَ مِنَ الْجُنْدِ، وَسَكَنَ الْحَالُ. ثُمَّ بَعْدَ أَيَّامٍ اجْتَمَعَ وُجُوهُ أَهْلِ قُرْطُبَةَ وَفُقَهَاؤُهَا، وَحَضَرُوا عِنْدَ مُحَمَّدِ بْنِ الْقَاسِمِ الْقُرَشِيِّ الْمَرْوَانِيِّ، عَمِّ هِشَامِ بْنِ حَمْزَةَ، وَأَخَذُوا لَهُ الْبَيْعَةَ عَلَى أَهْلِ الْبَلَدِ، وَعَرَّفُوهُ أَنَّ النَّاسَ قَدِ ارْتَضَوْهُ كَافَّةً، فَاسْتَنْظَرَ لَيْلَةً لِيَرَى رَأْيَهُ، وَيَسْتَخِيرَ اللَّهَ - سُبْحَانَهُ وَتَعَالَى - فَانْصَرَفُوا، فَحَضَرَ عِنْدَ الْحَكَمِ، وَأَطْلَعَهُ عَلَى الْحَالِ، وَأَعْلَمَهُ أَنَّهُ عَلَى بَيْعَتِهِ، فَطَلَبَ الْحَكَمُ تَصْحِيحَ الْحَالِ عِنْدَهُ، فَأَخَذَ مَعَهُ بَعْضَ ثِقَاتِ الْحَكَمِ، وَأَجْلَسَهُ فِي قُبَّةٍ فِي دَارِهِ، وَأَخْفَى أَمْرَهُ، وَحَضَرَ عِنْدَهُ الْقَوْمُ يَسْتَعْلِمُونَ مِنْهُ هَلْ تَقَلَّدَ أَمْرَهُمْ أَمْ لَا، فَأَرَاهُمُ الْمَخَافَةَ عَلَى نَفْسِهِ، وَعَظَّمَ الْخَطْبَ عَلَيْهِمْ، وَسَأَلَهُمْ تِعْدَادَ أَسْمَائِهِمْ وَمَنْ مَعَهُمْ، فَذَكَرُوا لَهُ جَمِيعَ مَنْ مَعَهُمْ مِنْ أَعْيَانِ الْبَلَدِ، وَصَاحِبُ الْحَكَمِ يَكْتُبُ أَسْمَاءَهُمْ، فَقَالَ لَهُمْ مُحَمَّدُ بْنُ الْقَاسِمِ: يَكُونُ هَذَا الْأَمْرُ يَوْمَ الْجُمُعَةِ، إِنْ شَاءَ اللَّهُ، فِي الْمَسْجِدِ الْجَامِعِ. وَمَشَى إِلَى الْحَكَمِ مَعَ صَاحِبِهِ، فَأَعْلَمَاهُ جَلِيَّةَ الْحَالِ، وَكَانَ ذَلِكَ يَوْمَ الْخَمِيسِ، فَمَا أَتَى عَلَيْهِ اللَّيْلُ حَتَّى حَبَسَ الْجَمَاعَةَ الْمَذْكُورِينَ عَنْ آخِرِهِمْ، ثُمَّ أَمَرَ بِهِمْ بَعْدَ أَيَّامٍ، فَصُلِبُوا عِنْدَ قَصْرِهِ، وَكَانُوا اثْنَيْنِ وَسَبْعِينَ رَجُلًا، مِنْهُمْ: أَخُو يَحْيَى بْنِ يَحْيَى، وَابْنُ أَبِي كَعْبٍ، وَكَانَ يَوْمُهُمْ يَوْمًا شَنِيعًا، فَتَمَكَّنَتْ عَدَاوَةُ النَّاسِ لِلْحَكَمِ.
Translation
✧ Al-Hakam's move against the people of Cordoba At the beginning of his governorship, al-Hakam openly engaged in drinking wine and indulging in pleasures. Cordoba was a house of learning, and it contained men of excellence in knowledge and piety, among them Yahya b. Yahya al-Laythi, the transmitter of Malik's Muwatta' from him, and others. The people of Cordoba rose up, denounced his behavior, stoned him, and wanted to kill him, but he was protected from them by the soldiers who were present, and the situation calmed down. A few days later, the leading figures and jurists of Cordoba gathered and came to Muhammad b. al-Qasim al-Qurashi al-Marwani, the uncle of Hisham b. Hamza. They took the oath of allegiance for him on behalf of the people of the city and informed him that the people had unanimously accepted him. He asked them to wait one night so that he could consider his opinion and seek guidance from God—glorified and exalted be He. They left. He then went to al-Hakam and informed him of the situation, assuring him that he remained loyal to his allegiance. Al-Hakam wanted to verify the matter, so he took with him one of al-Hakam's trusted men and seated him in a dome in his house, hiding his identity. The group came back to ask him whether he had assumed their cause or not. He showed them fear for his own safety, exaggerated the danger to them, and asked them to list their names and those with them. They mentioned all the leading men of the city who were with them, while al-Hakam's companion wrote down their names. Muhammad b. al-Qasim said to them: "This matter will take place on Friday, God willing, in the congregational mosque." He then went to al-Hakam with his companion, and they informed him of the clear situation. That was on Thursday. By nightfall, he had imprisoned all the aforementioned group to the last man. Then, after some days, he ordered them to be crucified near his palace. They numbered seventy-two men, among them the brother of Yahya b. Yahya and Ibn Abi Ka'b. That day was a horrible day, and the people's enmity toward al-Hakam became firmly established.
