Then the year 148 AH began

ثُمَّ دَخَلَتْ سَنَةُ ثَمَانٍ وَأَرْبَعِينَ وَمِائَةٍ ذِكْرُ خُرُوجِ حَسَّانِ بْنِ مُجَالِدٍ   وَفِيهَا خَرَجَ حَسَّانُ بْنُ مُجَالِدِ بْنِ يَحْيَى بْنِ مَالِكِ بْنِ الْأَجْدَعِ الْهَمْدَانِيُّ. وَمَالِكٌ هَذَا هُوَ أَخُو مَسْرُوقِ بْنِ الْأَجْدَعِ. وَكَانَ خُرُوجُهُ بِنَوَاحِي الْمَوْصِلِ بِقَرْيَةٍ تُسَمَّى بَافَخَّارَى قَرِيبٍ مِنَ الْمَوْصِلِ عَلَى دِجْلَةَ، فَخَرَجَ إِلَيْهِ عَسْكَرُ الْمَوْصِلِ، وَعَلَيْهَا الصَّقْرُ بْنُ نَجْدَةَ، وَكَانَ قَدْ وَلِيَهَا بَعْدَ حَرْبِ بْنِ عَبْدِ اللَّهِ، فَالْتَقَوْا وَاقْتَتَلُوا وَانْهَزَمَ عَسْكَرُ الْمَوْصِلِ إِلَى الْجِسْرِ. وَأَحْرَقَ الْخَوَارِجُ أَصْحَابُ حَسَّانٍ السُّوقَ هُنَاكَ وَنَهَبُوهُ  . ثُمَّ إِنَّ حَسَّانًا سَارَ إِلَى الرَّقَّةِ وَمِنْهَا إِلَى الْبَحْرِ وَدَخَلَ إِلَى بَلَدِ السِّنْدِ، وَكَانَتِ الْخَوَارِجُ مِنْ أَهْلِ عُمَانَ يُدْخِلُونَهُمْ وَيَدَعُونَهُمْ، فَاسْتَأْذَنَهُمْ فِي الْمَصِيرِ إِلَيْهِمْ، فَلَمْ يُجِيبُوهُ، فَعَادَ إِلَى الْمَوْصِلِ، فَخَرَجَ إِلَيْهِ الصَّقْرُ أَيْضًا، وَالْحَسَنُ بْنُ صَالِحِ بْنِ حَسَّانٍ الْهَمْدَانِيُّ، وَبِلَالٌ الْقَيْسِيُّ، فَالْتَقَوْا فَانْهَزَمَ الصَّقْرُ، وَأُسِرَ الْحَسَنُ بْنُ صَالِحٍ وَبِلَالٌ، فَقَتَلَ حَسَّانٌ بِلَالًا، وَاسْتَبْقَى الْحَسَنَ لِأَنَّهُ مِنْ هَمْدَانَ، فَفَارَقَهُ بَعْضُ أَصْحَابِهِ لِهَذَا. وَكَانَ حَسَّانٌ قَدْ أَخَذَ رَأْيَ الْخَوَارِجِ عَنْ خَالِهِ حَفْصِ بْنِ أَشْيَمَ، وَكَانَ مِنْ عُلَمَاءِ الْخَوَارِجِ وَفُقَهَائِهِمْ. وَلَمَّا بَلَغَ الْمَنْصُورَ خُرُوجُ حَسَّانٍ قَالَ: خَارِجِيٌّ مِنْ هَمْدَانَ ؟ قَالُوا: إِنَّهُ ابْنُ أُخْتِ حَفْصِ بْنِ أَشْيَمَ. فَقَالَ: فَمَنْ هُنَاكَ ؟ وَإِنَّمَا أَنْكَرَ الْمَنْصُورُ ذَلِكَ لِأَنَّ عَامَّةَ هَمْدَانَ شِيعَةٌ لَعَلِيٍّ، وَعَزَمَ الْمَنْصُورُ عَلَى إِنْفَاذِ الْجُيُوشِ إِلَى الْمَوْصِلِ وَالْفَتْكِ بِأَهْلِهَا. فَأَحْضَرَ أَبَا حَنِيفَةَ، وَ ابْنَ أَبِي لَيْلَى، وَ ابْنَ شُبْرُمَةَ، وَقَالَ لَهُمْ: إِنَّ أَهْلَ الْمَوْصِلِ شَرَطُوا إِلَيَّ أَنَّهُمْ لَا يَخْرُجُونَ عَلَيَّ، فَإِنْ فَعَلُوا حَلَّتْ دِمَاؤُهُمْ وَأَمْوَالُهُمْ، وَقَدْ خَرَجُوا. فَسَكَتَ أَبُو حَنِيفَةَ وَتَكَلَّمَ الرَّجُلَانِ وَقَالَا: رَعِيَّتُكَ، فَإِنْ عَفَوْتَ فَأَهْلُ ذَلِكَ أَنْتَ، وَإِنْ عَاقَبْتَ فَبِمَا يَسْتَحِقُّونَ. فَقَالَ لِأَبِي حَنِيفَةَ: أَرَاكَ سَكَتَّ يَا شَيْخُ ؟ فَقَالَ: يَا أَمِيرَ الْمُؤْمِنِينَ، أَبَاحُوكَ مَا لَا يَمْلِكُونَ، أَرَأَيْتَ لَوْ أَنَّ امْرَأَةً أَبَاحَتْ فَرْجَهَا بِغَيْرِ عَقْدِ نِكَاحٍ وَمِلْكِ يَمِينٍ، أَكَانَ يَجُوزُ أَنْ تُوطَأَ ؟ قَالَ: لَا ! وَكَفَّ عَنْ أَهْلِ الْمَوْصِلِ وَأَمَرَ أَبَا حَنِيفَةَ وَصَاحِبَيْهِ بِالْعَوْدِ إِلَى الْكُوفَةِ.

Translation

✧ Then the year 148 AH began Mention of the rising of Ḥassān b. Mujālid In it Ḥassān b. Mujālid b. Yaḥyā b. Mālik b. al-Ajdaʿ al-Hamdānī rose. This Mālik was the brother of Masrūq b. al-Ajdaʿ. His rising was in the environs of al-Mawṣil, at a village called Bāfakhkhārā, near al-Mawṣil on the Tigris. The troops of al-Mawṣil went out against him, under al-Ṣaqr b. Najdah, who had been appointed over it after Ḥarb b. ʿAbdallāh. They met and fought, and the troops of al-Mawṣil were defeated and fled to the bridge. The Kharijites, the followers of Ḥassān, burned the market there and plundered it. Then Ḥassān marched to al-Raqqah, and from there to the sea, and entered the land of al-Sind. The Kharijites of the people of ʿUmān used to admit them and summon them, so he sought their permission to go to them, but they did not answer him. So he returned to al-Mawṣil. Al-Ṣaqr went out against him again, with al-Ḥasan b. Ṣāliḥ b. Ḥassān al-Hamdānī and Bilāl al-Qaysī. They met, and al-Ṣaqr was defeated, and al-Ḥasan b. Ṣāliḥ and Bilāl were taken prisoner. Ḥassān killed Bilāl, and spared al-Ḥasan because he was from Hamdān, and for this reason some of his followers parted from him. Ḥassān had adopted the doctrine of the Kharijites from his maternal uncle Ḥafṣ b. Ashyam, who was one of the scholars and jurists of the Kharijites. When al-Manṣūr learned of Ḥassān's rising he said: 'A Kharijite from Hamdān?' They said: 'He is the son of the sister of Ḥafṣ b. Ashyam.' He said: 'Who is there?' Al-Manṣūr only found this strange because the common people of Hamdān were Shīʿa of ʿAlī, and al-Manṣūr resolved to send armies to al-Mawṣil and to destroy its people. He summoned Abū Ḥanīfah, Ibn Abī Laylā, and Ibn Shubrumah, and said to them: 'The people of al-Mawṣil stipulated to me that they would not rise against me, and that if they did so their blood and property would be lawful, and they have risen.' Abū Ḥanīfah remained silent, while the other two men spoke and said: 'They are your subjects. If you pardon them, you are worthy of that, and if you punish them, it is by what they deserve.' Then he said to Abū Ḥanīfah: 'I see you are silent, old man?' He said: 'O Commander of the Faithful, they permitted you what they do not possess. Consider: if a woman made her private parts lawful without a contract of marriage or ownership by the right hand, would it be permissible to have intercourse with her?' He said: 'No!' And he held back from the people of al-Mawṣil, and ordered Abū Ḥanīfah and his two companions to return to al-Kūfah.
