The caliphate of ʿUmar b. al-Khaṭṭāb

خَبَرِ سَلَمَةَ بْنِ قَيْسٍ الْأَشْجَعِيِّ وَالْأَكْرَادِ   كَانَ عُمَرُ إِذَا اجْتَمَعَ إِلَيْهِ جَيْشٌ مِنَ الْمُسْلِمِينَ أَمَّرَ عَلَيْهِمْ أَمِيرًا مِنْ أَهْلِ الْعِلْمِ وَالْفِقْهِ، فَاجْتَمَعَ إِلَيْهِ جَيْشٌ مِنَ الْمُسْلِمِينَ، فَبَعَثَ عَلَيْهِمْ سَلَمَةَ بْنَ قَيْسٍ الْأَشْجَعِيَّ. فَقَالَ: سِرْ بَاسْمِ اللَّهِ، قَاتِلْ فِي سَبِيلِ اللَّهِ مَنْ كَفَرَ بِاللَّهِ، فَإِذَا لَقِيتُمْ عَدُوَّكُمْ فَادْعُوهُمْ إِلَى الْإِسْلَامِ، فَإِنْ أَجَابُوا وَأَقَامُوا بِدَارِهِمْ فَعَلَيْهِمُ الزَّكَاةُ، وَلَيْسَ لَهُمْ مِنَ الْفَيْءِ نَصِيبٌ، وَإِنْ سَارُوا مَعَكُمْ فَلَهُمْ مِثْلُ الَّذِي لَكُمْ وَعَلَيْهِمْ مِثْلُ الَّذِي عَلَيْكُمْ، وَإِنْ أَبَوْا فَادْعُوهُمْ إِلَى الْجِزْيَةِ، فَإِنْ أَجَابُوا فَاقْبَلُوا مِنْهُمْ، وَإِنْ أَبَوْا فَقَاتِلُوهُمْ، وَإِنْ تَحَصَّنُوا مِنْكُمْ وَسَأَلُوكُمْ أَنْ يَنْزِلُوا عَلَى حُكْمِ اللَّهِ وَرَسُولِهِ. أَوْ ( ذِمَّةِ اللَّهِ وَرَسُولِهِ ) فَلَا تُجِيبُوهُمْ، فَإِنَّكُمْ لَا تَدْرُونَ أَتُصِيبُونَ حُكْمَ اللَّهِ وَرَسُولِهِ وَذِمَّتَهُمَا أَمْ لَا، وَلَا تَغْدِرُوا، وَلَا تَقْتُلُوا وَلِيدًا، وَلَا تُمَثِّلُوا. قَالَ: فَسَارُوا حَتَّى لَقُوا عَدُوًّا مِنَ الْأَكْرَادِ الْمُشْرِكِينَ فَدَعَوْهُمْ إِلَى الْإِسْلَامِ أَوِ الْجِزْيَةِ، فَلَمْ يُجِيبُوا، فَقَاتَلُوهُمْ فَهَزَمُوهُمْ وَقَتَلُوا الْمُقَاتِلَةَ وَسَبَوُا الذُّرِّيَّةَ، فَقَسَّمَهُ بَيْنَهُمْ، وَرَأَى سَلَمَةُ جَوْهَرًا فِي سَفَطٍ، فَاسْتَرْضَى عَنْهُ الْمُسْلِمِينَ وَبَعَثَ بِهِ إِلَى عُمَرَ. فَقَدِمَ الرَّسُولُ بِالْبِشَارَةِ وَالسَّفَطِ عَلَى عُمَرَ، فَسَأَلَهُ عَنْ أُمُورِ النَّاسِ وَهُوَ يُخْبِرُهُ، حَتَّى أَخْبَرَهُ بِالسَّفَطِ، فَغَضِبَ غَضَبًا شَدِيدًا وَأَمَرَ بِهِ فَوُجِئَ بِهِ فِي عُنُقِهِ، ثُمَّ إِنَّهُ قَالَ: إِنْ تَفَرَّقَ النَّاسُ قَبْلَ أَنْ تَقْدَمَ عَلَيْهِمْ وَيُقَسِّمَهُ سَلَمَةُ فِيهِمْ لَأَسُوءَنَّكَ. فَسَارَ حَتَّى قَدِمَ عَلَى سَلَمَةَ فَبَاعَهُ وَقَسَّمَهُ فِي النَّاسِ. وَكَانَ الْفَصُّ يُبَاعُ بِخَمْسَةِ دَرَاهِمَ، وَقِيمَتُهُ عِشْرُونَ أَلْفًا.

Translation

✧ The report of Salamah b. Qays al-Ashjaʿī and the Kurds When an army of the Muslims gathered before ʿUmar, he would appoint over them a commander from among the people of knowledge and jurisprudence. An army of the Muslims gathered before him, and he sent over them Salamah b. Qays al-Ashjaʿī. He said: March in the name of God; fight in the path of God against those who disbelieve in God. When you meet your enemy, call them to Islam. If they respond and remain in their abode, then the zakāh is upon them, and they have no share of the fayʾ. If they march with you, then they have the like of what you have, and upon them is the like of what is upon you. If they refuse, then call them to the jizyah. If they respond, accept it from them. If they refuse, then fight them. If they fortify themselves against you and ask you to descend upon the judgment of God and His Messenger—or 'the protection of God and His Messenger'—do not answer them, for you do not know whether you will attain the judgment of God and His Messenger and their protection or not. Do not act treacherously, do not kill a child, and do not mutilate. He said: They marched until they met an enemy from the polytheist Kurds. They called them to Islam or the jizyah, but they did not respond, so they fought them, defeated them, killed the fighting men, and captured the offspring. He divided it among them. Salamah saw a jewel in a basket, so he sought the Muslims' consent for it and sent it to ʿUmar. The messenger arrived with the good tidings and the basket before ʿUmar, and he asked him about the people's affairs while he was informing him, until he told him about the basket. He became intensely angry and ordered that he be struck on his neck. Then he said: If the people disperse before you arrive to them and Salamah divides it among them, I will surely harm you. So he traveled until he arrived before Salamah, sold it, and divided it among the people. The stone was sold for five dirhams, while its value was twenty thousand.
