حَدَّثَنَا حَسَنٌ حَدَّثَنَا ابْنُ لَهِيعَةَ حَدَّثَنَا جَعْفَرُ بْنُ رَبِيعَةَ عَنِ ابْنِ شِهَابٍ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ عَنْ عَائِشَةَ قَالَتْ قَالَ رَسُولُ اللهِ ﷺ 10
أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا، فَنِكَاحُهَا بَاطِلٌ، فَإِنْ أَصَابَهَا، فَلَهَا مَهْرُهَا بِمَا أَصَابَ مِنْ فَرْجِهَا، وَإِنِ اشْتَجَرُوا، فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ.

✧ Any woman married without the permission of her guardian, her marriage is invalid. If he has consummated with her, she is entitled to her dowry for what he has obtained from her private part. If they dispute, the ruler is the guardian of the one who has no guardian.
