حَدَّثَنَا وَكِيعٌ حَدَّثَنَا سُفْيَانُ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ عَيَّاشِ بْنِ أَبِي رَبِيعَةَ عَنْ حَكِيمِ بْنِ حَكِيمِ بْنِ عَبَّادِ بْنِ حُنَيْفٍ عَنْ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حُنَيْفٍأَنَّ رَجُلًا رَمَى رَجُلًا بِسَهْمٍ فَقَتَلَهُ وَلَيْسَ لَهُ وَارِثٌ إِلَّا خَالٌ فَكَتَبَ فِي ذَلِكَ أَبُو عُبَيْدَةَ بْنُ الْجَرَّاحِ إِلَى عُمَرَ فَكَتَبَ

أَنَّ رَجُلًا رَمَى رَجُلًا بِسَهْمٍ، فَقَتَلَهُ، وَلَيْسَ لَهُ وَارِثٌ إِلَّا خَالٌ، فَكَتَبَ فِي ذَلِكَ أَبُو عُبَيْدَةَ بْنُ الْجَرَّاحِ إِلَى عُمَرَ فَكَتَبَ: إِنَّ النَّبِيَّ ﷺ قَالَ: اللهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ، وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ.

✧ A man shot another man with an arrow and killed him, and he had no heir except a maternal uncle. Abu Ubaydah b. al-Jarrah wrote about that to Umar, so he wrote back: The Prophet ﷺ said: "Allah and His Messenger are the guardian of the one who has no guardian, and the maternal uncle is the heir of the one who has no heir."
