✧ They Return the Surplus

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: قُلْتُ لِعَطَاءٍ:
أَرَأَيْتَ إِنْ خُرِصَتْ نَخْلِي، فَبِعْتُهَا بَعْدَ الْخَرْصِ مِنْ نَاسٍ، فَأَقَمْتُ أَنَا الْبَيِّنَةَ عَلَى أَنَّهَا أَقَلُّ مِمَّا خُرِصَتْ، أَتَرَى أَنْ يَرُدُّوا عَلَيَّ الْفَضْلَ ؟ قَالَ: " إِنْ كَانَ الْخَرْصُ عَلَى عَهْدِ النَّبِيِّ ﷺ فَلَيْسَ لَكَ أَنْ يَرُدُّوا عَلَيْكَ الْفَضْلَ ". قُلْتُ: خَرَصُوا عَلَيَّ نَخْلِي، فَلَمَّا رَفَعْتُ تَمْرِي إِذَا هُوَ يَزِيدُ عَلَى خَرْصِهِمْ، أُؤَدِّي إِلَيْهِمُ الْفَضْلَ ؟ قَالَ: " لَا، إِنْ كَانَ عَلَى عَهْدِ النَّبِيِّ ﷺ ". قَالَ: قُلْتُ: أَرَأَيْتَ إِنْ بِعْتُ ثَمَرَ مَالِي قَبْلَ خُرُوجِ الْخَارِصِ، أَلَهُمْ أَنْ يُعِيدُوا بَيْعِي، فَيَخْرُصُوا قَالَ: " نَعَمْ، يَخْرُصُونَهُ إِنْ كَانَ الْخَرْصُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ، هُوَ أَحَقَّ ذَلِكَ، وَإِلَّا فَقَدْ بِعْتَ لَهُمْ، وَلَكَ، وَإِنْ بَاعَ ثَمَرًا بِذَهَبٍ فَإِنَّمَا الصَّدَقَةُ فِي الثَّمَرِ مَا كَانَ، وَلَيْسَ فِي الذَّهَبِ
Translation
✧ I said: Do you think that if my palms were estimated and then I sold them after the estimation to some people, and I established proof that it was less than what was estimated, do you think they should return the surplus to me? He said: "If the estimation was according to the practice of the Prophet ﷺ, then it is not for them to return the surplus to you." I said: They estimated my palms, and when I gathered up my dates, they were more than their estimation; should I pay the surplus to them? He said: "No, if it was according to the practice of the Prophet ﷺ." I said: Do you think that if I sold the fruit of my property before the estimator came, do they have the right to annul my sale and then estimate? He said: "Yes, they estimate it if the estimation is according to the practice of the Messenger of Allah ﷺ; that is more correct. Otherwise, you have sold to them and to yourself. If someone sold fruit for gold, then the zakāh is on the fruit as it actually is, and not on the gold."
