عَبْدُ الرَّزَّاقِ، قَالَ: أَخْبَرَنِي صَالِحُ بْنُ دِينَارٍ،
أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ، كَتَبَ إِلَى عُثْمَانَ بْنِ مُحَمَّدٍ يَنْهَاهُ أَنْ يَأْخُذَ مِنَ الْعَسَلِ صَدَقَةً إِلَّا أَنْ يَكُونَ النَّبِيُّ ﷺ أَخَذَهَا، فَجَمَعَ عُثْمَانُ أَهْلَ الْعَسَلِ فَشَهِدُوا أَنَّ هِلَالَ بْنَ سَعْدٍ جَاءَ رَسُولَ اللهِ ﷺ بِعَسَلٍ فَقَالَ: " مَا هَذِهِ ؟ " فَقَالَ: هَدِيَّةٌ " فَأَكَلَ النَّبِيُّ ﷺ " ثُمَّ جَاءَ مَرَّةً أُخْرَى، فَقَالَ: " مَا هَذِهِ ؟ " قَالَ: صَدَقَةٌ، فَأَخَذَهَا النَّبِيُّ ﷺ فَأَمَرَ بِرَفْعِهَا "، وَلَمْ يَذْكُرِ النَّبِيُّ ﷺ عِنْدَ ذَلِكَ عُشُورًا فِيهَا، وَلَا نِصْفَ عُشُورٍ، إِلَّا أَخَذَهَا، فَكَتَبَ بِذَلِكَ عُثْمَانُ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فَكَتَبَ: " فَأَنْتُمْ أَعْلَمُ، فَكُنَّا نَأْخُذُ مَا أَعْطَوْنَا مِنْ شَيْءٍ، وَلَا نَسْأَلُ عُشُورًا، وَلَا شَيْئًا، مَا أَعْطَوْنَا أَخَذْنَا
Translation
✧ Umar b. Abd al-Aziz wrote to Uthman b. Muhammad forbidding him from taking charity from honey unless the Prophet ﷺ had taken it. So Uthman gathered the honey owners, and they testified that Hilal b. Saʿd came to the Messenger of God ﷺ with honey, and he said: “What is this?” He said: “A gift.” So the Prophet ﷺ ate. Then he came another time, and he said: “What is this?” He said: “Charity.” So the Prophet ﷺ took it and ordered it to be lifted. And the Prophet ﷺ did not mention tithes or half-tithes on it then; he just took it. So Uthman wrote that to Umar b. Abd al-Aziz, and he wrote: “You know best. We used to take whatever they gave of anything, and we did not ask for tithes or anything; what they gave us we took.”
