أَخْبَرَنَا عَبْدُ الرَّزَّاقِ عَنْ هِشَامِ بْنِ حَسَّانَ يُحَدِّثُ أَنَّ مُحَمَّدَ بْنَ سِيرِينَ أَخْبَرَهُ قَالَ:
بِعْتُ بِرْذَوْنَةً لِي، وَكَفَلَ لِي غُلَامٌ لِعَبْدِ اللهِ بْنِ زِيَادٍ، فَجِئْتُ أَتَقَاضَاهُ. فَخَاصَمْنَا إِلَى سَيِّدِهِ، فَجَلَسْنَا بَيْنَ يَدَيْهِ فَجَعَلَ يَرْفَعُ صَوْتَهُ وَبَدَّلَ، فَقُلْتُ: ارْدُدْنِي وَإِيَّاهُ إِلَى الْقَاضِي ! فَأَرْسَلَ مَعَنَا رَسُولًا إِلَى شُرَيْحٍ، وَقَالَ: أَخْبِرْنِي بِالَّذِي يَقْضِي بَيْنَهُمَا ! قَالَ: فَانْطَلَقْنَا إِلَى شُرَيْحٍ، فَقَعَدْنَا بَيْنَ يَدَيْهِ، فَقُلْتُ: بِعْتُ بِرْذَوْنَةً لِي، وَكَفَلَ لِي غُلَامٌ لِابْنِ زِيَادٍ، فَحِيلَ بَيْنِي وَبَيْنَ غَرِيمِي، وَاقْتَضَى مَالِي مُسَمًّى، وَاقْتُسِمَ مَالُ غَرِيمِي دُونِي ! فَأَجَابَنِي شُرَيْحٌ، فَقَالَ: " إِنْ كَانَ مُخَيَّرًا، وَكَفَلَ لَكَ - غَرِمَ، وَإِنْ كَانَ اقْتَضَى مَالَكَ مُسَمًّى فَأَنْتَ أَحَقُّ بِهِ، وَإِنْ كَانَ الْغُرَمَاءُ أَخَذُوا مَالَهُ دُونَكَ فَهُوَ بَيْنَكُمْ بِالْحِصَصِ ". فَرَجَعَ إِلَيْهِ الرَّسُولُ فَأَخْبَرَهُ، فَلَمْ يَقُلْ شَيْئًا

I sold a pony of mine, and a slave of ʿUbaydullāh b. Ziyād stood surety for me. I came to demand payment from him, and we brought our dispute to his master. We sat before him, and he began to raise his voice and changed [his words]. So I said: "Send me and him back to the judge!" So he sent a messenger with us to Shurayḥ, and said: "Inform me of what he rules between them!" He said: So we went to Shurayḥ and sat before him. I said: "I sold a pony of mine, and a slave of Ibn Ziyād stood surety for me. Then I was kept away from my debtor, and my specified property was collected, and my debtor's property was divided without me!" Shurayḥ answered me and said: "If he was given a choice and stood surety for you, he must pay. If he collected your specified property, you have more right to it. And if the creditors took his property without you, then it is to be shared among you in proportion to your shares." Then the messenger returned to him and informed him, and he said nothing.
