أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: أَخْبَرَنَا مَعْمَرٌ عَنْ أَيُّوبَ، عَنِ ابْنِ سِيرِينَ قَالَ:
بِعْتُ بِرْذَوْنَةً لِي، وَكَفَلَ لِي غُلَامٌ لِابْنِ زِيَادٍ، فَخَاصَمْتُهُ إِلَى شُرَيْحٍ، فَقُلْتُ: حِيلَ بَيْنِي وَبَيْنَ كَفِيلِي، وَاقْتَضَى مَالِي مُسَمًّى، وَاقْتُسِمَ مَالُ غَرِيمِي دُونِي ! فَأَجَابَنِي شُرَيْحٌ فَقَالَ: " إِنْ كَانَ مُخَيَّرًا، وَكَفَلَ لَكَ - غَرِمَ، وَإِنْ كَانَ اقْتَضَى مَالَكَ مُسَمًّى فَأَنْتَ أَحَقُّ بِهِ، وَإِنْ كَانَ مَالُهُ اقْتُسِمَ دُونَكَ فَهُوَ بِالْحِصَصِ
