حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ ثنا أَبُو نُعَيْمٍ الْفَضْلُ بْنُ دُكَيْنٍ ثنا الْحَارِثُ بْنُ سُلَيْمٍ الْكِنْدِيُّ ثنا كُرْدُوسٌ التَّغْلِبِيُّ عَنِ الْأَشْعَثِ بْنِ قَيْسٍ الْكِنْدِيِّ
أَنَّ رَجُلًا مِنْ كِنْدَةَ وَرَجُلًا مِنْ حَضْرَمَوْتَ اخْتَصَمَا إِلَى النَّبِيِّ ﷺ فِي أَرْضٍ بِالْيَمَنِ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللهِ أَرْضِي اغْتَصَبَهَا أَبُو هَذَا؟ فَقَالَ لِلْكِنْدِيِّ «مَا تَقُولُ؟» قَالَ أَقُولُ إِنَّ أَرْضِي فِي يَدِي وَرِثْتُهَا مِنْ أَبِي فَقَالَ لِلْحَضْرَمِيِّ «هَلْ لَكَ مِنْ بَيِّنَةٍ؟» قَالَ لَا وَلَكِنْ يَحْلِفُ يَا رَسُولَ اللهِ بِالَّذِي لَا إِلَهَ إِلَّا اللهُ هُوَ مَا يَعْلَمُ أَنَّهَا أَرْضِي اغْتَصَبَهَا أَبُوهُ فَتَهَيَّأَ الْكِنْدِيُّ لِلْيَمِينِ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّهُ لَا يَقْتَطِعُ رَجُلٌ مَالًا إِلَّا لَقِيَ اللهَ ﷻ يَوْمَ الْقِيَامَةِ وَهُوَ أَجْذَمُ» فَرَدَّهَا الْكِنْدِيُّ

✧ A man from Kindah and a man from Hadramawt brought a dispute before the Prophet ﷺ concerning a piece of land in Yemen. The Hadrami said, 'O Messenger of God, it is my land; this man's father usurped it from me.' He said to the Kindi, 'What do you say?' He said, 'I say it is my land, in my possession; I inherited it from my father.' He said to the Hadrami, 'Do you have any proof?' He said, 'No, but let him swear, O Messenger of God, by the One besides whom there is no god, that he does not know it is my land which his father usurped.' The Kindi prepared to take the oath, and the Messenger of God ﷺ said, 'No man seizes property but that he will meet God ﷻ on the Day of Resurrection with it as a leper.' So the Kindi returned it.
