حَدَّثَنَا مُطَّلِبُ بْنُ شُعَيْبٍ الْأَزْدِيُّ ثنا عَبْدُ اللهِ بْنُ صَالِحٍ حَدَّثَنِي اللَّيْثُ حَدَّثَنِي عَقِيلٌ عَنِ ابْنِ شِهَابٍ عَنْ سَهْلِ بْنِ سَعْدٍ

أَنَّهُ قَالَ إِنَّ رَجُلًا مِنَ الْأَنْصَارِ جَاءَ رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ؟ فَأَنْزَلَ اللهُ ﷻ فِي شَأْنِهِ مَا ذُكِرَ فِي الْقُرْآنِ مِنَ التَّلَاعُنِ فَقَالَ «قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ» قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ ثُمٌّ فَارَقَهَا عِنْدَ رَسُولِ اللهِ ﷺ فَكَانَتِ السُّنَّةُ بَعْدُ فِيهِمَا أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا فَكَانَ ابْنُهَا يُدْعَى إِلَى أُمِّهِ ثُمَّ جَرَتِ السُّنَّةُ فِي الْمِيرَاثِ أَنَّهُ يَرِثُهَا ابْنُهَا وَتَرِثُ مِنْهُ مَا فُرِضَ لَهَا

✧ He said that a man from the Ansar came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, what do you think about a man who finds another man with his wife? Should he kill him?" Then Allah ﷻ revealed concerning his affair what is mentioned in the Quran about invoking curses. He said, "It has been decreed concerning you and your wife." He said, "Then they invoked curses on each other while I was present. Then he parted from her in the presence of the Messenger of Allah ﷺ. After that, the sunna was that separation should be made between the two who invoke curses. She was pregnant, and he denied her pregnancy. Her son was called after his mother. Then the sunna in inheritance was that her son would inherit her, and she would inherit from him what was prescribed for her."
