حَدَّثَنَا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ سَعِيدِ بْنِ أَبِي مَرْيَمَ ثنا مُحَمَّدُ بْنُ يُوسُفَ الْفِرْيَابِيُّ ثنا الْأَوْزَاعِيُّ حَدَّثَنِي الزُّهْرِيُّ عَنْ سَهْلِ بْنِ سَعْدٍ السَّاعِدِيِّ أَنَّ عُوَيْمِرًا أَتَى عَاصِمَ بْنَ عَدِيٍّ وَكَانَ سَيِّدَ بَنِي الْعَجْلَانِ فَقَالَ

كَيْفَ تَقُولُ فِي رَجُلٍ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ وَقَالَ سَلْ لِي رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَأَتَى عَاصِمٌ النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ رَجُلٌ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ قَالَ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ فَسَأَلَهُ عُوَيْمِرٌ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ كَرِهَ الْمَسَائِلَ وَعَابَهَا قَالَ عُوَيْمِرٌ وَاللهِ لَا أَنْتَهِي حَتَّى أَسْأَلَ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ قَالَ فَجَاءَ عُوَيْمِرٌ فَقَالَ يَا رَسُولَ اللهِ رَجُلٌ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَقَالَ رَسُولُ اللهِ ﷺ «قَدْ أُنْزِلَ الْقُرْآنُ فِيكَ وَفِي صَاحِبَتِكَ» وأمَرَهُمَا رَسُولُ اللهِ ﷺ بِالْمُلَاعَنَةِ بِمَا بَيَّنَهَا اللهُ فِي كِتَابِهِ فَتَلَاعَنَا ثُمَّ قَالَ يَا رَسُولَ اللهِ إِنْ حَبَسْتُهَا فَقَدْ ظَلَمْتُهَا قَالَ ثُمَّ طَلَّقَهَا فَكَانَتْ سُنَّةً لِمَنْ جَاءَ بَعْدَهُمَا مِنَ الْمُتَلَاعِنَيْنِ فَقَالَ رَسُولُ اللهِ ﷺ «انْظُرُوا فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ عَظِيمَ الْأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ فَلَا أَحْسَبُ إِلَّا عُوَيْمِرٌ قَدْ صَدَقَ عَلَيْهَا وَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ كَأَنَّهُ وَحَرَةٌ فَلَا أَحْسَبُ عُوَيْمِرًا إِلَّا قَدْ كَذَبَ عَلَيْهَا» قَالَ فَجَاءَتْ بِهِ عَلَى النَّعْتِ الَّذِي نَعَتَ رَسُولُ اللهِ ﷺ مِنْ تَصْدِيقِ عُوَيْمِرٍ وَكَانَ نَسَبُ هَذَا إِلَى أُمِّهِ

✧ "What do you say about a man who finds another man with his wife? Should he kill him, and then you would kill him, or what should he do?" And he said, "Ask the Messenger of Allah ﷺ about that for me." So 'Asim went to the Prophet ﷺ and said, "O Messenger of Allah, a man finds another man with his wife. Should he kill him, and then you would kill him, or what should he do?" He said, "The Messenger of Allah ﷺ disliked such questions." Then 'Uwaymir asked him, and he said, "The Messenger of Allah ﷺ disliked such questions and criticized them." 'Uwaymir said, "By Allah, I will not stop until I ask the Messenger of Allah ﷺ about that." He said, "So 'Uwaymir came and said, 'O Messenger of Allah, a man finds another man with his wife. Should he kill him, and then you would kill him, or what should he do?' The Messenger of Allah ﷺ said, 'Quran has been revealed concerning you and your companion.' And the Messenger of Allah ﷺ commanded them to invoke curses on each other according to what Allah clarified in His Book. So they invoked curses on each other. Then he said, 'O Messenger of Allah, if I keep her, then I have wronged her.'" He said, "Then he divorced her, and that became a sunna for those who came after them among those who invoke curses. The Messenger of Allah ﷺ said, 'Look, if she gives birth to a child who is black, with dark eyes, large buttocks, and thick legs, then I think 'Uwaymir has told the truth against her; but if she gives birth to a reddish child, as if he were a small lizard, then I think 'Uwaymir has lied against her.'" He said, "She gave birth to the child with the description that the Messenger of Allah ﷺ mentioned, confirming 'Uwaymir, and this child's lineage was attributed to his mother."
