حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ

ثنا الْقَعْنَبِيُّ عَنْ مَالِكٍ وَحَدَّثَنَا بَكْرُ بْنُ سَهْلٍ ثنا عَبْدُ اللهِ بْنُ يُوسُفَ أَنَا مَالِكٌ عَنِ ابْنِ شِهَابٍ أَنَّ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ أَخْبَرَهُ أَنَّ عُوَيْمِرَ بْنَ أَشْقَرَ الْعَجْلَانِيَّ أَتَى عَاصِمَ بْنَ عَدِيٍّ الْأَنْصَارِيَّ فَقَالَ لَهُ يَا عَاصِمُ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ سَلْ لِي يَا عَاصِمُ عَنْ ذَلِكَ رَسُولَ اللهِ ﷺ فَسَأَلَ عَاصِمٌ عَنْ ذَلِكَ رَسُولَ اللهِ ﷺ فَكَرِهَ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَأَلَ رَسُولَ اللهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ أَتَاهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللهِ ﷺ؟ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَطُّ قَدْ كَرِهَ رَسُولُ اللهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَا أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللهِ ﷺ وَهُوَ فِي وَسَطِ النَّاسِ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ فَقَالَ رَسُولُ اللهِ ﷺ «قَدْ أَنْزَلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَائْتِ بِهَا» فَقَالَ سَهْلٌ فَتَلَاعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللهِ ﷺ فَلَمَّا فَرَغَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا عُوَيْمِرٌ ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ قَالَ ابْنُ شِهَابٍ «فَكَانَتْ سُنَّةَ الْمُتَلَاعِنَيْنِ»

✧ Al-Qa'nabi narrated to us from Malik; and Bakr b. Sahl narrated to us, 'Abd Allah b. Yusuf narrated to us, Malik informed us from Ibn Shihab that Sahl b. Sa'd al-Sa'idi informed him that 'Uwaymir b. Ashqar al-'Ajlani came to 'Asim b. 'Adi al-Ansari and said to him, "O 'Asim, what do you think about a man who finds another man with his wife? Should he kill him, and then you would kill him, or what should he do? Ask the Messenger of Allah ﷺ about that for me, O 'Asim." So 'Asim asked the Messenger of Allah ﷺ about that, and he disliked such questions and criticized them, until 'Asim felt distressed about what he had asked the Messenger of Allah ﷺ. When 'Asim returned to his family, 'Uwaymir came to him and said, "O 'Asim, what did the Messenger of Allah ﷺ say to you?" 'Asim said to 'Uwaymir, "You have never brought me any good. The Messenger of Allah ﷺ disliked the question I asked him." 'Uwaymir said, "By Allah, I will not stop until I ask him about it myself." So 'Uwaymir went until he came to the Messenger of Allah ﷺ while he was in the midst of the people and said, "O Messenger of Allah, what do you think about a man who finds another man with his wife? Should he kill him, and then you would kill him, or what should he do?" The Messenger of Allah ﷺ said, "It has been revealed concerning you and your companion. Go and bring her." Sahl said, "Then they invoked curses on each other while I was with the people in the presence of the Messenger of Allah ﷺ. When they finished, 'Uwaymir said, 'I have lied against her if I keep her.' So 'Uwaymir divorced her three times before the Messenger of Allah ﷺ commanded him." Ibn Shihab said, "That became the sunna for the two who invoke curses."
