حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ
ثنا الْقَعْنَبِيُّ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ أَنَّهُمَا أَخْبَرَاهُ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللهِ اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَقَالَ الْآخَرُ وَكَانَ أَفْقَهَهُمَا أَجَلْ يَا رَسُولَ اللهِ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي بِأَنْ أَتَكَلَّمَ أَوِ ائْذَنْ لِي فِي أَنْ أَتَكَلَّمَ فَقَالَ رَسُولُ اللهِ ﷺ «تَكَلَّمْ» فَقَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا وَالْعَسِيفُ الْأَجِيرُ فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِئَةِ شَاةٍ وَجَارِيَةٍ لِي ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ فَقَالَ رَسُولُ اللهِ ﷺ «أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ إِلَيْكَ» وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا الْأَسْلَمِيَّ أَنْ يَأْتِيَ امْرَأَةَ الْآخَرَ فَإِنِ اعْتَرَفَتْ رَجَمَهَا فَاعْتَرَفَتْ فَرَجَمَهَا

✧ Al-Qa'nabi narrated to us from Malik, from Ibn Shihab, from 'Ubayd Allah b. 'Abd Allah, from Abu Hurayrah and Zayd b. Khalid al-Juhani, that they informed him that two men brought a dispute to the Messenger of God ﷺ. One of them said: “O Messenger of God, judge between us according to the Book of God,” and the other, who was the more knowledgeable of the two, said: “Yes, O Messenger of God, judge between us according to the Book of God, and give me permission to speak.” Or he said: “Permit me to speak.” The Messenger of God ﷺ said: “Speak.” He said: “My son was a hired worker for this man—and al-'asif means the hired worker—and he committed adultery with his wife. They told me that my son was subject to stoning, so I ransomed him with a hundred sheep and a slave girl of mine. Then I asked the people of knowledge, and they told me that my son was subject to a hundred lashes and exile for a year, and that stoning was only upon his wife.” The Messenger of God ﷺ said: “Indeed, by the One in Whose hand is my soul, I will certainly judge between you according to the Book of God: as for your sheep and your slave girl, they are to be returned to you.” So he had his son flogged with a hundred lashes and exiled for a year, and he ordered Unays al-Aslami to go to the other man's wife, and if she confessed, to stone her. She confessed, and he stoned her.
