حَدَّثَنَا أَبُو يَزِيدَ الْقَرَاطِيسِيُّ ثنا عَبْدُ اللهِ بْنُ عَبْدِ الْحَكَمِ أَنَا مَالِكٌ وَاللَّيْثُ وَسُفْيَانُ بْنُ عُيَيْنَةَ وَبَعْضُهُمْ يَزِيدُ عَلَى بَعْضٍ عَنِ ابْنِ شِهَابٍ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ قَالَ

سُفْيَانُ وَشِبْلٍ إِنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللهِ اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَقَالَ الْآخَرُ وَهُوَ أَفْقَهُهُمْ أَجَلْ يَا رَسُولَ اللهِ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ «تَكَلَّمْ» قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا قَالَ وَالْعَسِيفُ الْأَجِيرُ فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِئَةِ شَاةٍ وَبِجَارِيَةٍ لِي ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأُخْبِرْتُ أَنَّمَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَأَنَّ الرَّجْمَ عَلَى امْرَأَتِهِ فَقَالَ رَسُولُ اللهِ ﷺ «أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا جَارِيَتُكَ وَغَنَمُكَ فَرَدٌّ إِلَيْكَ» وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا الْأَسْلَمِيَّ أَنْ يَأْتِيَ امْرَأَةَ الْآخَرِ فَإِنِ اعْتَرَفَتْ رَجَمَهَا فَاعْتَرَفَتْ فَرَجَمَهَا

✧ Sufyan and Shibl: that two men brought a dispute to the Messenger of God ﷺ. One of them said: “O Messenger of God, judge between us according to the Book of God,” and the other, who was the more knowledgeable of them, said: “Yes, O Messenger of God, so judge between us according to the Book of God, and give me permission to speak.” He said: “Speak.” He said: “My son was a hired worker for this man”—he said: “and al-'asif is the hired worker”—“and he committed adultery with his wife. They told me that my son was subject to stoning, so I ransomed him with a hundred sheep and a slave girl of mine. Then I asked the people of knowledge, and I was informed that my son was only subject to a hundred lashes and exile for a year, and that stoning was upon his wife.” The Messenger of God ﷺ said: “Indeed, by the One in Whose hand is my soul, I will certainly judge between you according to the Book of God: as for your slave girl and your sheep, they are to be returned to you.” So he had his son flogged with a hundred lashes and exiled for a year, and he ordered Unays al-Aslami to go to the other man's wife, and if she confessed, to stone her. She confessed, and he stoned her.
