حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ أَنَا عَبْدُ الرَّزَّاقِ أَنَا ابْنُ جُرَيْجٍ أَخْبَرَنِي ابْنُ شِهَابٍ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُتْبَةَ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ
أَنَّ رَجُلًا مِنَ الْأَعْرَابِ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَنْشُدُكَ اللهَ إِلَّا قَضَيْتَ لِي بِكِتَابِ اللهِ فَقَالَ الْخَصْمُ الْآخَرُ وَهُوَ أَفْقَهُ مِنْهُ نَعَمْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي فَقَالَ رَسُولُ اللهِ ﷺ «قُلْ» قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهَ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِئَةِ شَاةٍ وَوَلِيدَةٍ ثُمَّ سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونَا إِنَّمَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَأَنَّ عَلَى امْرَأَتَهِ الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ الْغَنَمُ وَالْوَلِيدَةُ رَدٌّ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاحِدٍ وَاغْدُ يَا أُنَيْسُ لِرَجُلٍ مِنْ أَسْلَمَ عَلَى امْرَأَةٍ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا» فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَأَمَرَ بِهَا رَسُولُ اللهِ ﷺ فَرُجِمَتْ

✧ That a man from the Bedouins came to the Messenger of God ﷺ and said: “O Messenger of God, I adjure you by God to judge for me according to the Book of God.” The other disputant, who was more knowledgeable than him, said: “Yes, so judge between us according to the Book of God, and give me permission [to speak].” The Messenger of God ﷺ said: “Speak.” He said: “My son was a hired worker for this man, and he committed adultery with his wife. They told me that my son was subject to stoning, so I ransomed him with a hundred sheep and a slave girl. Then I asked the people of knowledge, and they told us that my son was only subject to a hundred lashes and exile for a year, and that stoning was upon his wife.” The Messenger of God ﷺ said: “By the One in Whose hand is my soul, I will certainly judge between you according to the Book of God: the sheep and the slave girl are to be returned, and upon your son is a hundred lashes and exile for one year. O Unays, go to the wife of this man, and if she confesses, stone her.” So he went to her in the morning, and she confessed, and the Messenger of God ﷺ ordered her stoned, and she was stoned.
