حَدَّثَنَا يُوسُفُ الْقَاضِي ثنا أَحْمَدُ بْنُ عِيسَى الْمِصْرِيُّ ثنا ابْنُ وَهْبٍ أَخْبَرَنِي جَرِيرُ بْنُ حَازِمٍ عَنْ يَعْلَى بْنِ حَكِيمٍ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ رَافِعِ بْنِ خَدِيجٍ قَالَ
كُنَّا نُحَاقِلُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَالْمُحَاقَلَةُ أَنْ يُكْرِيَ الرَّجُلُ أَرْضَهُ بِالثُّلُثِ أَوِ الرُّبُعِ أَوْ بِطَعَامٍ مُسَمًّى فَأَتَى بَعْضُ عُمُومَتِهِ فَقَالَ نَهَانَا رَسُولُ اللهِ ﷺ عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا طَوَاعِيَةُ اللهِ وَرَسُولِهِ أَنْفَعُ لَنَا قَالَ رَسُولُ اللهِ ﷺ «مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيُزْرِعْهَا أَخَاهُ وَلَا يُكْرِيهَا بِالثُّلُثِ وَالرُّبُعِ وَلَا بِطَعَامٍ مُسَمًّى»

✧ We used to practice muḥāqalah at the time of the Messenger of God ﷺ, and muḥāqalah is when a man leases his land for a third or a quarter or for a specified amount of food. Then one of his paternal uncles came and said, “The Messenger of God ﷺ forbade us from a matter that was beneficial to us; obedience to God and His Messenger is more beneficial for us. The Messenger of God ﷺ said, ‘Whoever has land, let him cultivate it or have his brother cultivate it, and not lease it for a third and a quarter and not for a specified amount of food.’”
