حَدَّثَنَا عُبَيْدُ بْنُ غَنَّامٍ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا عَبْدَةُ بْنُ سُلَيْمَانَ ح وَحَدَّثَنَا إِسْحَاقُ بْنُ خَالَوَيْهِ الْوَاسِطِيُّ حَدَّثَنَا الْعَبَّاسُ بْنُ الْوَلِيدِ النَّرْسِيُّ ثنا يَزِيدُ بْنُ زُرَيْعٍ قَالَا ثنا سَعِيدُ بْنُ أَبِي عَرُوبَةَ عَنْ يَعْلَى بْنِ حَكِيمٍ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ رَافِعِ بْنِ خَدِيجٍ قَالَ
كُنَّا نُحَاقِلُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَالْمُحَاقَلَةُ أَنْ يُعْطِيَ الرَّجُلُ أَرْضَهُ عَلَى الثُّلُثِ أَوِ الرُّبُعِ أَوْ عَلَى طَعَامٍ مُسَمًّى فَأَتَانَا بَعْضُ عُمُومَتِي فَقَالَ نَهَانَا النَّبِيُّ ﷺ عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا وَطَوَاعِيَةُ اللهِ وَطَوَاعِيَةُ رَسُولِهِ أَنْفَعُ لَنَا قُلْنَا وَمَا ذَاكَ؟ قَالَ قَالَ نَبِيُّ اللهِ ﷺ «مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا أَوْ لِيُزْرِعْهَا أَخَاهُ وَلَا يُكَارِيهَا بِثُلُثٍ أَوْ رُبْعٍ وَلَا بِطَعَامٍ مُسَمًّى»

✧ We used to practice muḥāqalah at the time of the Messenger of God ﷺ, and muḥāqalah is when a man gives his land for a third or a quarter or for a specified amount of food. Then one of my paternal uncles came to us and said, “The Prophet ﷺ forbade us from a matter that was beneficial to us, but obedience to God and obedience to His Messenger is more beneficial for us.” We said, “And what is that?” He said, “The Prophet of God ﷺ said, ‘Whoever has land, let him cultivate it or have his brother cultivate it, and not lease it for a third or a quarter or for a specified amount of food.’”
