حَدَّثَنَا مُعَاذُ بْنُ الْمُثَنَّى ثنا مُسَدَّدٌ ثنا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ ثنا أَيُّوبُ عَنْ يَعْلَى بْنُ حَكِيمٍ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ عَنْ رَافِعِ بْنِ خَدِيجٍ قَالَ
كُنَّا نُحَاقِلُ بِالْأَرْضِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَنُكْرِيهَا عَلَى الثُّلُثِ وَالرُّبُعِ وَالطَّعَامِ الْمُسَمَّى فَجَاءَنَا ذَاتَ يَوْمٍ رَجُلٌ مِنْ عُمُومَتِي فَقَالَ «نَهَانَا رَسُولُ اللهِ ﷺ عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا وَطَوَاعِيَةُ اللهِ وَرَسُولُهُ أَنْفَعُ لَنَا نَهَانَا أَنْ نُحَاقِلَ الْأَرْضَ أَنْ نُكْرِيَهَا عَلَى الثُّلُثِ وَالرُّبُعِ وَالطَّعَامِ الْمُسَمَّى وَأَمَرَ رَبَّ الْأَرْضِ أَنْ يَزْرَعَهَا أَوْ يُزْرِعَهَا وَكَرِهَ كِرَاءَهَا وَمَا سِوَى ذَلِكَ»

✧ We used to practice muḥāqalah with land at the time of the Messenger of God ﷺ, leasing it for a third, a quarter, and a specified amount of food. Then one day a man from among my paternal uncles came to us and said, “The Messenger of God ﷺ forbade us from a matter that was beneficial to us, but obedience to God and His Messenger is more beneficial for us. He forbade us to practice muḥāqalah with land, to lease it for a third, a quarter, and a specified amount of food. He commanded the owner of the land to cultivate it or have it cultivated, and he disliked leasing it for anything other than that.”
