حَدَّثَنَا مُعَاذُ بْنُ الْمُثَنَّى ثنا مُسَدَّدٌ ثنا يَزِيدُ بْنُ زُرَيْعٍ ثنا سَعِيدُ بْنُ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ عَنْ أَبِي الْمَلِيحِ بْنِ أُسَامَةَ
أَنَّ حَمَلَ بْنَ مَالِكِ بْنِ النَّابِغَةِ كَانَتْ تَحْتَهُ ضَرَّتَانِ مُلَيْكَةُ وَأُمُّ عَفِيفٍ فَرَمَتْ إِحْدَاهُمَا صَاحِبَتَهَا بِحَجَرٍ فَأَصَابَتْ قُبُلَهَا فَأَلْفَتْ جَنِينًا مَيِّتًا وَمَاتَتْ فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ فَجَعَلَ دِيَتَهَا عَلَى قَوْمِ الْقَاتِلَةِ وَجَعَلَ فِي جَنِينِهَا غُرَّةٌ عَبْدٌ أَوْ أَمَةٌ أَوْ عِشْرِينَ مِنَ الْإِبِلِ أَوْ مِائَةَ شَاةٍ فَقَالَ وَلِيُّهَا وَاللهِ يَا نَبِيَّ اللهِ مَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ فَاسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ فَقَالَ النَّبِيُّ ﷺ «لَسْنَا مِنْ أَسَاجِيعِ الْجَاهِلِيَّةِ فِي شَيْءٍ»

✧ That Hamal b. Malik b. al-Nabigha had two co-wives, Mulayka and Umm ʿAfif. One of them threw a stone at her companion and struck her private part, and she cast a dead fetus and died. That was brought to the Prophet ﷺ, and he made her blood money the responsibility of the clan of the killer, and for her fetus he made a ghurra: a male or female slave, or twenty camels, or one hundred sheep. Her guardian said, “By God, O Prophet of God, it did not eat or drink or cry out, so such a one should be disregarded.” The Prophet ﷺ said, “We have nothing to do with the rhymed prose of the Age of Ignorance.”
