حَدَّثَنَا عَبْدَانُ بْنُ أَحْمَدَ ثنا كَثِيرُ بْنُ عُبَيْدٍ الْحَذَّاءُ ثنا بَقِيَّةُ بْنُ الْوَلِيدِ عَنْ عُتْبَةَ بْنِ أَبِي عُتْبَةَ عَنْ سُلَيْمَانَ بْنِ عَمْرٍو عَنِ الضَّحَّاكِ بْنِ النُّعْمَانِ بْنِ سَعْدٍ
أَنَّ مَسْرُوقَ بْنَ وَائِلٍ قَدِمَ عَلَى رَسُولِ اللهِ ﷺ بِالْمَدِينَةِ بِالْعَقِيقِ فَأَسْلَمَ وَحَسُنَ إِسْلَامُهُ قَالَ يَا رَسُولَ اللهِ إِنِّي أُحِبُّ أَنْ تَبْعَثَ إِلَى قَوْمِي رَجُلًا يَدْعُوهُمْ إِلَى الْإِسْلَامِ وَأَنْ تَكْتُبَ لَنَا كِتَابًا إِلَى قَوْمِي عَسَى اللهُ أَنْ يَهْدِيَهُمْ بِهَا فَقَالَ لِمُعَاوِيَةَ اكْتُبْ لَهُ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ إِلَى الْأَفْنَادِ مِنْ حَضْرَمَوْتٍ بِإِقَامِ الصَّلَاةِ وَإِيتَاءِ الزَّكَاةِ وَالصَّدَقَةِ عَلَى السَّعَةِ وَالتِّيمَةِ فِي السُّيُوبِ الْخُمُسُ وَفِي الْبَعْلِ الْعُشْرُ لَا خِلَاطَ وَلَا وِرَاطَ وَلَا شِغَارَ وَلَا شِنَاقَ وَلَا جَنَبَ وَلَا جَلَبَ وَلَا يُجْمَعُ بَيْنَ بَعِيرَيْنِ فِي عِقَالِ مَنْ أَجْبَا فَقَدْ أَرْبَى وَكُلُّ مُسْكِرٍ حَرَامٌ «وَبَعَثَ إِلَيْهِمْ زِيَادَ بْنَ لَبِيدٍ الْأَنْصَارِيَّ» أَمَّا الْخِلَاطُ فَلَا تُجْمَعُ الْمَاشِيَةُ وَأَمَّا الْوِرَاطُ فَلَا يُقَوِّمُهَا بِالْقِيمَةِ وَأَمَّا الشِّغَارُ فَيُزَوِّجُ الرَّجُلُ ابْنَتَهُ وَيُنْكِحُهُ الْآخَرُ ابْنَتَهُ بِلَا مَهْرٍ وَالشِّنَاقُ أَنْ يَعْقِلَهَا فِي مَبَارِكِهَا وَالْإِجْبَاءُ أَنْ تُبَاعَ الثَّمَرَةُ قَبْلَ أَنْ تُؤْمَنَ عَلَيْهَا الْعَاهَةُ

✧ Masruq b. Wa'il came to the Messenger of God ﷺ in Madinah at al-'Aqiq, embraced Islam, and his Islam was good. He said, "O Messenger of God, I would like you to send to my people a man to call them to Islam and to write a letter for us to my people, that perhaps God may guide them by it." So he said to Mu'awiya, "Write for him: In the name of God, the Most Gracious, the Most Merciful. To the Afnad of Hadramawt: regarding performing prayer, giving zakat, charity according to one's means, the animal kept at home for milk, and the fifth on hidden treasures; on well-irrigated land one-tenth. No combining, no separating, no shighar marriage, no tying a pregnant camel's legs to prevent her young from nursing, no keeping animals away from water to gather them for zakat, no driving them to the collector, no two camels tied together in one hobble. Whoever withholds zakat has committed usury. Every intoxicant is forbidden." And he sent Ziyad b. Labid al-Ansari to them. As for combining, it is not gathering flocks together; as for separating, it is not separating them to reduce the number; as for shighar, it is a man marrying off his daughter on condition that the other marries him to his daughter without a dowry; as for shinaq, it is tying a camel in its resting place; and as for ijba', it is selling fruit before it is safe from blight.
