حَدَّثَنَا عَمْرُو بْنُ أَبِي الطَّاهِرِ الْمِصْرِيُّ ثنا مُحَمَّدُ بْنُ عَزِيزٍ الْأَيْلِيُّ ثنا سَلَامَةُ بْنُ رَوْحٍ عَنْ عُقَيْلٍ أَخْبَرَنِي ابْنُ شِهَابٍ أَنَّ عَطَاءَ بْنَ يَزِيدَ اللَّيْثِيَّ ثُمَّ الْجُنْدَعِيَّ أَخْبَرَهُ أَنَّ عُبَيْدَ اللهِ بْنَ عَدِيِّ بْنِ الْخِيَارِ أَخْبَرَهُ أَنَّ الْمِقْدَادَ بْنَ عَمْرٍو الْكِنْدِيَّ حَلِيفَ بَنِي زُهْرَةَ قَالَ
يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ لَقِيتُ رَجُلًا مِنَ الْكُفَّارِ فَقَاتَلَنِي فَضَرَبَ إِحْدَى يَدَيَّ فَقَطَعَهَا ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ قَالَ أَسْلَمْتُ لِلَّهِ أَقْتُلَهُ يَا رَسُولَ اللهِ؟ فَقَالَ رَسُولُ اللهِ ﷺ «لَا تَقْتُلْهُ» قَالَ يَا رَسُولَ اللهِ إِنَّهُ قَطَعَ إِحْدَى يَدَيَّ ثُمَّ قَالَ ذَلِكَ بَعْدَ مَا قَطَعَهَا قَالَ رَسُولُ اللهِ ﷺ «فَإِنْ قَتَلْتَهُ فَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ وَهُوَ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ»

✧ "O Messenger of Allah, what do you think if I meet a man from the disbelievers and he fights me, and he strikes one of my hands and cuts it off, then he seeks refuge from me behind a tree and says, 'I have submitted to Allah.' Should I kill him, O Messenger of Allah?" The Messenger of Allah ﷺ said: "Do not kill him." He said, "O Messenger of Allah, he cut off one of my hands, then he said that after cutting it off." The Messenger of Allah ﷺ said: "If you kill him, then you are in his position before he uttered his word that he said, and he is in your position before you kill him."
