حَدَّثَنَا عُمَرُ بْنُ عَبْدِ الْعَزِيزِ بْنِ مِقْلَاصٍ حَدَّثَنِي أَبِي ثنا ابْنُ وَهْبٍ أَخْبَرَنِي حَيْوَةُ بْنُ شُرَيْحٍ عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ عَنْ سَلَمَةَ بْنِ أُسَامَةَ عَنْ يَحْيَى بْنِ الْحَكَمِ أَنَّ مُعَاذَ بْنَ جَبَلٍ قَالَ

بَعَثَنِي رَسُولُ اللهِ ﷺ مُصَدِّقًا إِلَى أَهْلِ الْيَمَنِ وَأَمَرَنِي أَنْ آخُذَ مِنَ الْبَقَرِ مِنْ كُلِّ ثَلَاثِينَ تَبِيعًا وَالتَّبِيعُ الْجَذَعُ أَوْ تَبِيعَةً وَمِنْ كُلِّ أَرْبَعِينَ مُسِنَّةً قَالَ فَعَرَضُوا عَلَيَّ أَنْ آخُذَ مَا بَيْنَ الْأَرْبَعِينَ وَالْخَمْسِينَ وَبَيْنَ السِّتِّينَ وَالسَّبْعِينَ وَمَا بَيْنَ الثَّمَانِينَ وَالتِّسْعِينَ فَأَبَيْتُ عَلَيْهِمْ وَقُلْتُ لَهُمْ حَتَّى أَسْأَلَ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَقَدِمْتُ فَأَخْبَرْتُ النَّبِيَّ ﷺ «فَأَمَرَنِي أَنْ آخُذَ مِنْ كُلِّ ثَلَاثِينَ تَبِيعًا وَمِنَ الْأَرْبَعِينَ مُسِنَّةً وَمِنَ السِّتِّينَ تَبِيعَتَيْنِ وَمِنَ السَّبْعِينَ مُسِنَّةً وَتَبِيعًا وَمِنَ الثَّمَانِينَ مُسِنَّتَيْنِ وَمِنَ التِّسْعِينَ ثَلَاثَةَ أَتَابِيعَ وَمِنَ الْمِائَةِ مُسِنَّةً وَتَبِيعَيْنِ وَمِنَ الْعَشْرِ وَماِئَةٍ مُسِنَّتَيْنِ وَتَبِيعًا وَمِنَ الْعِشْرِينَ وَماِئَةٍ ثَلَاثَةَ مُسِنَّاتٍ أَوْ أَرْبَعَةَ أَتَابِيعَ وَأَمَرَنِي رَسُولُ اللهِ ﷺ أَنْ لَا آخُذَ مِنْ مَا بَيْنَ ذَلِكَ شَيْئًا إِلَى أَنْ يَبْلُغَ مُسِنَّةً أَوْ جَذَعًا وَزَعَمَ أَيْضًا أَنَّ الْأَوْقَاصَ لَا فَرِيضَةَ فِيهَا»

✧ The Messenger of Allah ﷺ sent me as a zakat collector to the people of Yemen and ordered me to take from cattle: from every thirty a tabi' — the tabi' being a one-year-old — or a tabi'ah, and from every forty a musinnah. He said: They proposed that I take what is between forty and fifty, between sixty and seventy, and between eighty and ninety; but I refused them and said to them: 'Until I ask the Messenger of Allah ﷺ about that.' So I came and informed the Prophet ﷺ, and he ordered me to take from every thirty a tabi', from forty a musinnah, from sixty two tabi'ahs, from seventy a musinnah and a tabi', from eighty two musinnahs, from ninety three tabi's, from one hundred a musinnah and two tabi's, from one hundred and ten two musinnahs and a tabi', and from one hundred and twenty three musinnahs or four tabi's. And the Messenger of Allah ﷺ ordered me not to take anything from what falls between those numbers until it reaches a musinnah or a jadha'. He also asserted that the awqas (gaps between the specified numbers) have no obligatory zakat.
