حَدَّثَنَا أَحْمَدُ بْنُ زُهَيْرٍ التُّسْتَرِيُّ ثنا يُوسُفُ بْنُ مُوسَى الْقَطَّانُ ثنا جَرِيرٌ عَنْ أَشْعَثَ بْنِ سَوَّارٍ عَنِ الزُّهْرِيِّ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ قَالَ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ فَقَالَتْ إِنَّ ابْنَ ابْنِي أَوِ ابْنَ ابْنَتِي مَاتَ فَذَكَرَ

أَنَّ لِي حَقًّا فِيمَا تَرَكَ فَمَا حَقِّي؟ قَالَ أَبُو بَكْرٍ مَا أَعْلَمُ لَكِ فِي كِتَابِ اللهِ شَيْئًا وَسَأَسْأَلُ فَارْجِعِي فَلَمَّا صَلَّى الظُّهْرَ قَالَ مَنْ سَمِعَ مِنْ رَسُولِ اللهِ ﷺ فِي الْجَدَّاتِ شَيْئًا؟ قَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ أَنَا سَمِعْتُهُ قَالَ كَيْفَ سَمِعْتَهُ؟ قَالَ «أَعْطَى الْجَدَّةَ السُّدُسَ» قَالَ هَلْ عَلِمَ ذَلِكَ أَحَدٌ غَيْرُكُ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ فَقَالَ صَدَقَ هُوَ كَمَا قَالَ فَجَاءَتِ الْمَرْأَةُ فَأَعْطَاهَا السُّدُسَ فَلَمَّا قُبِضَ أَبُو بَكْرٍ ؓ وَكَانَ عُمَرُ ؓ أَتَتْهُ امْرَأَةٌ فِي مِثْلِ ذَلِكَ فَقَالَتْ مَا قَالَتِ الْمَرْأَةُ الَّتِي قَالَتْ لِأَبِي بَكْرٍ فَرَدَّ عَلَيْهَا مِثْلَ قَوْلِهِ ثُمَّ سَأَلَ فَقَالُوا إِنَّ الْمُغِيرَةَ قَالَ كَذَا وَكَذَا وَشَهِدَ مَعَهُ مُحَمَّدُ بْنُ مَسْلَمَةَ فَأَعْطَاهَا السُّدُسَ وَقَالَ عُمَرُ مِنْ قِبَلِهِ إِذَا اجْتَمَعْتُمَا فَهُوَ لَكُمَا وَأَيُّكُمَا خَلَتْ بِهِ فَهُوَ لَهَا

✧ She said: 'I have a right in what he left, so what is my right?' Abu Bakr said: 'I do not know of anything for you in the Book of God. I will ask; so return.' When he had prayed the noon prayer, he said: 'Who heard anything from the Messenger of God ﷺ regarding grandmothers?' al-Mughirah b. Shu'bah said: 'I heard him.' He said: 'How did you hear him?' He said: 'He gave the grandmother a sixth.' He said: 'Does anyone other than you know that?' Then Muhammad b. Maslamah stood and said: 'He spoke the truth; it is as he said.' So the woman came and he gave her a sixth. When Abu Bakr ؓ passed away, and it was Umar ؓ, a woman came to him about the like of that and said what the woman who had spoken to Abu Bakr had said. He replied to her with the like of his answer. Then he asked, and they said: 'al-Mughirah said such-and-such, and Muhammad b. Maslamah testified with him.' So he gave her a sixth. Then Umar said on his own initiative: 'If you two are both present, it is for you both; but whichever of you is alone with it, it is for her.'
