حَدَّثَنَا أَبُو يَزِيدُ الْقَرَاطِيسِيُّ ثنا عَبْدُ اللهِ بْنُ الْحَكَمِ أَنَا مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ عُثْمَانَ بْنِ إِسْحَاقَ بْنِ خَرَشَةَ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ قَالَ

جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ تَسْأَلُهُ مِيرَاثَهَا فِي كِتَابِ اللهِ فَقَالَ لَهَا أَبُو بَكْرٍ مَا لَكِ فِي كِتَابِ اللهِ شَيْءٌ وَمَا عَلِمْتُ لَكِ فِي سُنَّةِ رَسُولِ اللهِ ﷺ شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ فَسَأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ «حَضَرْتُ رَسُولَ اللهِ ﷺ أَعْطَاهَا السُّدُسَ» فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ الْأَنْصَارِيُّ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ ثُمَّ جَاءَتِ الْجَدَّةُ الْأُخْرَى عُمَرَ بْنَ الْخَطَّابِ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لِكِ فِي كِتَابِ اللهِ شَيْءٌ وَمَا كَانَ الْقَضَاءُ الَّذِي قُضِيَ بِهِ إِلَّا لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ شَيْئًا وَلَكِنْ هُوَ ذَلِكَ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فِيهِ فَهُوَ بَيْنَكُمَا وَأَيُّكُمَا خَلَتْ بِهِ فَهُوَ لَهَا

✧ A grandmother came to Abu Bakr al-Siddiq asking about her inheritance in the Book of God. Abu Bakr said to her, “You have nothing in the Book of God, and I do not know of anything for you in the Sunnah of the Messenger of God ﷺ. Go back until I ask the people.” He asked the people, and al-Mughira b. Shu‘ba said, “I was present when the Messenger of God ﷺ gave her one-sixth.” Abu Bakr said, “Is there anyone else with you?” Muhammad b. Maslamah al-Ansari stood and said the like of what al-Mughira said, so Abu Bakr carried it out for her. Then the other grandmother came to Umar b. al-Khattab asking about her inheritance. He said, “You have nothing in the Book of God. The ruling that was made was only for the other one, not you. I will not add anything to the prescribed shares, but it is that sixth. If you both are present, it is between you, and whichever of you is alone, it is hers.”
