حَدَّثَنَا عَبْدَانُ بْنُ أَحْمَدَ قَالَ: نَا أَبُو مُوسَى الْأَنْصَارِيُّ قَالَ: نَا تَلِيدُ بْنُ سُلَيْمَانَ أَبُو إِدْرِيسَ، عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ، عَنِ الزُّهْرِيِّ، عَنْ مَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ قَالَ:
أَتَى الْعَبَّاسُ وَعَلِيٌّ أَبَا بَكْرٍ لَمَّا اسْتُخْلِفَ، يَطْلُبَانِ مِيرَاثَهُمَا مِنْ رَسُولِ اللهِ ﷺ، فَجَاءَ عَلِيٌّ يَطْلُبُ نَصِيبَ فَاطِمَةَ، وَجَاءَ الْعَبَّاسُ يَطْلُبُ نَصِيبَهُ مِمَّا كَانَ فِي يَدِ رَسُولِ اللهِ ﷺ، فَقَالَ أَبُو بَكْرٍ: لَا أَرَى ذَلِكَ، إِنَّ رَسُولَ اللهِ ﷺ كَانَ يَقُولُ: إِنَّا مَعْشَرَ الْأَنْبِيَاءِ لَا نُورَثُ، مَا تَرَكْنَا فَهُوَ صَدَقَةٌ "، فَقَامَ قَوْمٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ، فَشَهِدُوا بِذَلِكَ قَالُوا: فَدَعْنَا حَتَّى يَكُونَ فِي أَيْدِينَا عَلَى مَا كَانَتْ فِي يَدِ رَسُولِ اللهِ ﷺ قَالَ: لَا أَرَى ذَلِكَ، أَنَا الْوَالِي مِنْ بَعْدِهِ، وَأَنَا أَحَقُّ بِذَلِكَ مِنْكُمَا، أَضَعُهَا فِي مَوَاضِعِهَا الَّتِي كَانَ النَّبِيُّ ﷺ يَضَعُهَا فِيهِ، فَأَبَى أَنْ يَدْفَعَ إِلَيْهِمَا شَيْئًا، فَلَمَّا وَلِيَ عُمَرُ أَتَيَاهُ قَالَ: كَأَنِّي لَعِنْدَ عُمَرَ وَقَدْ أَتَاهُ مَالٌ، فَقَالَ: خُذْ هَذَا الْمَالَ، فَاقْسِمْهُ فِي قَوْمِكَ إِذْ جَاءَهُ الْإِذْنُ، فَقَالَ: بِالْبَابِ أُنَاسٌ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ، فَقَالَ: ائْذَنْ لَهُمْ، فَدَخَلُوا فَجَلَسُوا قَالَ: ثُمَّ أَتَاهُ، فَقَالَ: عَلِيٌّ وَالْعَبَّاسُ بِالْبَابِ، فَقَالَ: ائْذَنْ لَهُمْ فَدَخَلَا، فَقَالَ عُمَرُ: مَا جَاءَ بِكُمَا ؟ مَا قَدْ طَلَبْتُمَاهُ مِنْ أَبِي بَكْرٍ فَلَمْ يَدْفَعْهُ إِلَيْكُمَا ؟ قَالَ: فَتَرَدَّدَا عَلَيْهِ فِيهَا، فَقَالَ: أَدْفَعُهَا إِلَيْكُمَا عَلَى أَنِّي آخُذُ عَلَيْكُمَا عَهْدًا وَمِيثَاقًا، أَنْ تَعْمَلَا فِيهِ مَا كَانَ يَعْمَلُ بِهِ رَسُولُ اللهِ ﷺ فَخُذَاهَا، فَأَعْطَاهُمَا فَقَبَضَاهَا، ثُمَّ مَكَثَا مَا شَاءَ اللهُ، ثُمَّ إِنَّهُمَا اخْتَصَمَا فِيمَا بَيْنَهُمَا إِلَى عُمَرَ، وَعِنْدَهُ نَاسٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ، فَاخْتَصَمَا بَيْنَ يَدَيْهِ، فَقَالَا مَا شَاءَ اللهُ أَنْ يَقُولَا، فَقَالَ بَعْضُ أَصْحَابِ النَّبِيِّ ﷺ: يَا أَمِيرَ الْمُؤْمِنِينَ: اقْضِ بَيْنَهُمَا وَأَرِحْ كُلَّ وَاحِدٍ مِنْهُمَا مِنْ صَاحِبِهِ، فَقَالَ عُمَرُ: وَاللهِ لَا أَقْضِي فِيهَا أَبَدًا إِلَّا قَضَاءً قَضَيْتُهُ، فَإِنْ عَجَزْتُمَا عَنْهَا، فَرُدَّاهَا إِلَيَّ، كَمَا دَفَعْتُهَا إِلَيْكُمَا، فَقَامَا مِنْ عِنْدِهِ

✧ Al-ʿAbbas and ʿAli came to Abu Bakr when he was appointed caliph, seeking their inheritance from the Messenger of Allah ﷺ. ʿAli came seeking Fatimah's share, and al-ʿAbbas came seeking his share of what had been in the Messenger of Allah's ﷺ possession. Abu Bakr said: “I do not think that. The Messenger of Allah ﷺ used to say: ‘We, the company of prophets, do not inherit. What we leave is charity.’” A group of the Prophet's ﷺ Companions stood and testified to that. They said: “Then leave it in our hands as it was in the Messenger of Allah's ﷺ hand.” He said: “I do not think that. I am the guardian after him, and I am more entitled to it than you two. I will place it where the Prophet ﷺ used to place it.” He refused to hand anything over to them. When ʿUmar became caliph, they came to him. He said: “It is as if I am with ʿUmar when wealth came to him, and he said: ‘Take this wealth and distribute it among your people,’ when permission came to him. He said: ‘There are people at the door from the Companions of the Messenger of Allah ﷺ.’ He said: ‘Give them permission.’ They entered and sat. Then he came to him and said: ‘ʿAli and al-ʿAbbas are at the door.’ He said: ‘Give them permission.’ They entered. ʿUmar said: ‘What has brought you two? Did you not seek from Abu Bakr what he did not hand over to you?’ They went back and forth with him about it. He said: ‘I will hand it over to you on condition that I take from you a covenant and solemn promise that you will do with it what the Messenger of Allah ﷺ used to do.’ So they took it, and he gave it to them, and they received it. They remained as long as Allah willed, then they disputed between themselves and brought the case to ʿUmar, while with him were people from the Companions of the Prophet ﷺ. They argued before him and said whatever Allah willed they said. Some of the Prophet's ﷺ Companions said: ‘O Commander of the Faithful, judge between them and relieve each of them from the other.’ ʿUmar said: ‘By Allah, I will never judge in this matter except as I judged before. If you two are unable to handle it, return it to me as I handed it to you.’ So they rose from his presence.”
