حَدَّثَنَا أَحْمَدُ بْنُ عَمْرٍو، قَالَ: نَا يَحْيَى بْنُ دُرُسْتَ قَالَ: نَا مُحَمَّدُ بْنُ ثَابِتٍ قَالَ: نَا يَعْقُوبُ بْنُ عَطَاءِ بْنِ أَبِي رَبَاحٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ قَالَ:
سُئِلَ رَسُولُ اللهِ ﷺ، عَنْ ضَالَّةِ الْإِبِلِ ؟ فَقَالَ: دَعْهَا، مَعَهَا الْحِذَاءُ وَالسِّقَاءُ، تَأْكُلُ مِنَ الشَّجَرِ، وَتَشْرَبُ مِنَ الْمَاءِ، حَتَّى يَأْخُذَهَا رَبُّهَا ". فَقِيلَ لَهُ: ضَالَّةُ الْغَنَمِ ؟ فَقَالَ: " لَكَ أَوْ لِأَخِيكَ، أَوْ لِلذِّئْبِ ". فَقِيلَ: يَا رَسُولَ اللهِ، حَرِيسَةُ الْجَبَلِ ؟ فَقَالَ: " غُرْمُهَا وَمِثْلُهُ مَعَهُ، وَجَلَدَاتٌ نَكَالًا، فَإِنْ آوَاهَا الْمُرَاحُ فَمَا بَلَغَ ثَمَنَ الْمِجَنِّ فَفِيهِ الْقَطْعُ ". قَالُوا: يَا رَسُولَ اللهِ، وَالثَّمَرُ الْمُعَلَّقُ ؟ قَالَ: " غُرْمُهُ، وَمِثْلُهُ مَعَهُ، وَجَلَدَاتٌ نَكَالًا، فَإِذَا آوَاهَا الْجَرِينُ، فَمَا بَلَغَ ثَمَنَ الْمِجَنِّ فَفِيهِ الْقَطْعُ ". قَالُوا: يَا رَسُولَ اللهِ، فَاللُّقَطَةُ تُوجَدُ، فَقَالَ: " مَا كَانَ فِي قَرْيَةٍ مَسْكُونَةٍ أَوْ طَرِيقٍ مِيتَاءٍ فَعَرِّفْهُ سَنَةً، فَإِنْ وَجَدْتَ وَإِلَّا فَاسْتَمْتِعْ بِهَا ". قِيلَ: يَا رَسُولَ اللهِ، فَالرِّكَازُ ؟ قَالَ: " فِي الرِّكَازِ الْخُمُسُ

✧ The Messenger of Allah ﷺ was asked about a stray camel. He said: Leave it; it has its tough feet and its water-skin, it eats from the trees and drinks from the water until its owner takes it. Then it was said to him: A stray sheep? He said: It is for you, or for your brother, or for the wolf. Then it was said: O Messenger of Allah, what about the mountain livestock? He said: Its fine and its like with it, and lashes as a punishment. But if it is brought into the fold, and its value reaches the price of a shield, then cutting off the hand applies. They said: O Messenger of Allah, and hanging fruit? He said: Its fine and its like with it, and lashes as a punishment. But if it is brought into the threshing floor, and its value reaches the price of a shield, then cutting off the hand applies. They said: O Messenger of Allah, and a found item? He said: What is in an inhabited village or a well-trodden road, announce it for a year. If you find its owner, then return it; otherwise, enjoy it. It was said: O Messenger of Allah, and buried treasure? He said: On buried treasure, one-fifth is due.
