أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ قَالَ حَدَّثَنَا اللَّيْثُ عَنِ ابْنِ شِهَابٍ عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ عَنْ أَبِي هُرَيْرَةَ
أَنَّ رَجُلًا وَقَعَ بِامْرَأَتِهِ فِي رَمَضَانَ فَاسْتَفْتَى رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَقَالَ «هَلْ تَجِدُ رَقَبَةً؟» قَالَ لَا قَالَ «هَلْ تَسْتَطِيعُ صِيَامَ شَهْرَيْنِ؟» قَالَ لَا قَالَ «فَأَطْعِمْ سِتِّينَ مِسْكِينًا» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا الصَّوَابُ وَحَدِيثُ أَشْهَبَ عَنِ اللَّيْثِ خَطَأٌ يَنْبَغِي أَنْ يَكُونَ أَشْهَبُ حَمَلَ حَدِيثَ اللَّيْثِ عَلَى حَدِيثِ مَالِكٍ

✧ That a man had intercourse with his wife in Ramadan and asked the Messenger of Allah ﷺ about that. He said, 'Can you find a slave?' He said, 'No.' He said, 'Can you fast two months?' He said, 'No.' He said, 'Then feed sixty poor people.' Abu Abd al-Rahman said: This is the correct version, and the hadith of Ashhab from al-Layth is a mistake. Ashhab probably applied the hadith of al-Layth to the hadith of Malik.
