أَخْبَرَنَا مُحَمَّدُ بْنُ الْعَلَاءِ حَدَّثَنَا أَبُو مُعَاوِيَةَ حَدَّثَنَا الْأَعْمَشُ عَنْ عَبْدِ اللهِ بْنِ مُرَّةَ عَنِ الْبَرَاءِ بْنِ عَازِبٍ قَالَ

مُرَّ عَلَى رَسُولِ اللهِ ﷺ بِيَهُودِيٍّ مُحَمَّمٍ مَجْلُودٍ فَدَعَاهُمْ فَقَالَ «هَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ؟» قَالُوا نَعَمْ فَدَعَا رَجُلًا مِنْ عُلَمَائِهِمْ فَقَالَ «أَنْشُدُكَ بِاللهِ الَّذِي أَنْزَلَ التَّوْرَاةَ عَلَى مُوسَى أَهَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ؟» فَقَالَ لَا وَلَوْلَا مَا نَشَدْتَنِي لَمْ أُخْبِرْكَ نَجِدُ حَدَّ الزَّانِي فِي كِتَابِنَا الرَّجْمُ وَلَكِنَّهُ ظَهَرَ فِي أَشْرَافِنَا فَكُنَّا إِذَا أَخَذْنَا الرَّجُلَ الشَّرِيفَ تَرَكْنَاهُ وَإِذَا أَخَذْنَا الرَّجُلَ الضَّعِيفَ أَقَمْنَا عَلَيْهِ الْحَدَّ فَقُلْنَا تَعَالَوْا نَجْتَمِعُ عَلَى شَيْءٍ نُقِيمُهُ عَلَى الشَّرِيفِ وَالْوَضِيعِ فَاجْتَمَعْنَا عَلَى التَّحَمُّمِ وَالْجِلْدِ وَتَرَكْنَا الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ «إِنِّي أَوَّلُ مَنْ أَحْيَا أَمَرَكَ إِذْ أَمَاتُوهُ» فَأَمَرَ بِهِ فَرُجِمَ فَأَنْزَلَ اللهُ ﷻ {يَا أَيُّهَا الرَّسُولُ لَا يَحْزُنْكَ الَّذِينَ يُسَارِعُونَ فِي الْكُفْرِ} [المائدة 41] إِلَى {وَإِنْ لَمْ تُؤْتَوْهُ فَاحْذَرُوا} [المائدة 41] يَقُولُ ائْتُوا مُحَمَّدًا فَإِنْ أَفْتَاكُمْ بِالتَّحَمُّمِ وَالْجَلْدِ فَخُذُوهُ وَإِنْ أَفْتَاكُمْ بِالرَّجْمِ فَاحْذَرُوا إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ} [المائدة 44] فِي الْيَهُودِ وَإِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الظَّالِمُونَ} [المائدة 45] فِي الْيَهُودِ إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أُنْزِلَ اللهُ فَأُولَئِكَ هُمُ الْفَاسِقُونَ} [المائدة 47] قَالَ فِي الْكُفَّارِ كُلُّهَا يَعْنِي الْآيَةَ

Translation

✧ A Jew who had been blackened and flogged was brought past the Messenger of Allah ﷺ. He called them and said, 'Is this how you find the punishment of the adulterer in your Book?' They said, 'Yes.' He called a man from their scholars and said, 'I adjure you by Allah who revealed the Torah to Musa: Is this how you find the punishment of the adulterer in your Book?' He said, 'No, and if you had not adjured me I would not have told you. We find the punishment of the adulterer in our Book to be stoning, but it became prevalent among our nobles. When we seized a noble man we let him go, and when we seized a weak man we carried out the punishment on him. We said, "Come, let us agree on something we will apply to noble and lowly alike." So we agreed on blackening and flogging and abandoned stoning.' The Messenger of Allah ﷺ said, 'I am the first to revive your command since they killed it.' He ordered, and he was stoned. Then Allah ﷻ revealed: {O Messenger, let not those grieve you who hasten into disbelief} [al-Ma'idah: 41] to {and if you are not given it, then beware} [al-Ma'idah: 41], meaning: 'Go to Muhammad. If he gives you a ruling of blackening and flogging, accept it; if he gives you a ruling of stoning, beware.' Up to His saying: {And whoever does not judge by what Allah has revealed, then those are the disbelievers} [al-Ma'idah: 44] concerning the Jews, and to His saying: {And whoever does not judge by what Allah has revealed, then those are the wrongdoers} [al-Ma'idah: 45] concerning the Jews, and to His saying: {And whoever does not judge by what Allah has sent down, then those are the defiantly disobedient} [al-Ma'idah: 47]. He said, 'All of it, meaning the verse, is concerning the disbelievers.'
