✧ A man from the people of Fadak committed adultery. The people of Fadak wrote to some Jews in Madinah: "Ask Muhammad about this. If he orders you to flog, then take it from him; but if he orders you to stone, then do not take it from him." So they asked him about it. He said: "Send to me the two most learned men among you." They brought a one-eyed man called Ibn Suriya and another. The Prophet ﷺ said to them: "Are you two the most learned of those before you?" They said: "Our people have inclined to that." The Prophet ﷺ said to them: "Do you not have the Torah, which contains the ruling of Allah, Exalted is He?" They said: "Yes." The Prophet ﷺ said: "I adjure you by the One who parted the sea for Musa, shaded you with clouds, saved you from the people of Pharaoh, and sent down manna and quails upon the Children of Israel: What do you find in the Torah concerning stoning?" One of them said to the other: "We have never been adjured by anything like this." Then he said: "We find that repeated looking is fornication, and embracing is fornication. If four witnesses testify that they saw him engaging in the act as a probe enters a kohl container, then stoning becomes obligatory." The Prophet ﷺ said: "That is it." So he ordered him and he was stoned. Then the verse was revealed: "So if they come to you, judge between them or turn away from them..."
