✧ Penalty for Hunting and Its Prohibition for the Muhrim

- مُسَدَّدٌ: حَدَّثَنَا يَحْيَى، عَنِ ابْنِ خُثَيْمٍ، أَخْبَرَنِي يُوسُفُ بْنُ مَاهَكَ، أَنَّهُ سَمِعَ عَبْدَ اللهِ بْنَ أَبِي عَمَّارٍ، يَقُولُ:

أَقْبَلْتُ مَعَ مُعَاذِ بْنِ جَبَلٍ، وَكَعْبٍ ؓ مُحْرِمِينَ بِعُمْرَةٍ مِنْ بَيْتِ الْمَقْدِسِ، وَأَمِيرُنَا مُعَاذٌ ؓ وَأَمْرُنَا إِلَيْهِ، وَهُوَ يَؤُمُّنَا. فَلَمَّا كَانَ بِبَعْضِ الطَّرِيقِ تَبَرَّزَ مُعَاذٌ ؓ لِحَاجَتِهِ، وَخَالَفَهُ رَجُلٌ بِحِمَارِ وَحْشٍ قَدْ عَقَرَهُ، فَأَخَذَهُ كَعْبٌ، فَأَهْدَاهُ إِلَى الرُّفْقَةِ. قَالَ: فَلَمْ يَرْجِعْ مُعَاذٌ إِلَّا وَقُدُورُ الْقَوْمِ تَغْلِي فِيهَا مِنْهُ. فَسَأَلَ، فَأُخْبِرَ، فَقَالَ: لَا يُطِيعُنِي أَحَدٌ إِلَّا كَفَأَ قِدْرَهُ !. قَالَ: فَكَفَأَ كَعْبٌ وَالْقَوْمُ قُدُورَهُمْ. فَلَمَّا كُنَّا بِبَعْضِ الطَّرِيقِ، وَكَعْبٌ يُصَلِّي عَلَى نَارٍ، إِذْ مَرَّتْ بِهِ رِجْلٌ مِنْ جَرَادٍ، فَأَخَذَ جَرَادَتَيْنِ فَقَتَلَهُمَا وَنَسِيَ إِحْرَامَهُ، ثُمَّ ذَكَرَ إِحْرَامَهُ فَرَمَى بِهِمَا. فَلَمَّا قَدِمْنَا الْمَدِينَةَ دَخَلَ الْقَوْمُ عَلَى عُمَرَ ؓ وَدَخَلْتُ مَعَهُمْ، فَقَالَ كَعْبٌ: كَيْفَ تَرَى يَا أَمِيرَ الْمُؤْمِنِينَ - فَقَصَّ عَلَيْهِ قِصَّةَ الْجَرَادَتَيْنِ - ؟ قَالَ: وَمَا بَأْسٌ بِذَلِكَ، يَا كَعْبُ. قَالَ: نَعَمْ. قَالَ: إِنَّ حِمْيَرَ تُحِبُّ الْجَرَادَ، وَمَاذَا جَعَلْتَ فِي نَفْسِكَ ؟ قَالَ: دِرْهَمَيْنِ. قَالَ: دِرْهَمَانِ خَيْرٌ مِنْ مِائَةِ جَرَادَةٍ، اجْعَلْ مَا جَعَلْتَ فِي نَفْسِكَ

✧ I set out with Mu'adh b. Jabal and Ka'b ؓ in a state of ihram for 'Umrah from Jerusalem, and our leader was Mu'adh ؓ and our affair was entrusted to him, and he led us in prayer. When we were on part of the road, Mu'adh ؓ went aside to relieve himself, and a man brought him a wild donkey that he had hamstrung, and Ka'b took it and gave it as a gift to the traveling companions. He said: Mu'adh did not return except when the people's pots were boiling with it. He asked and was informed, and he said: 'Let no one obey me except that he overturns his pot!' He said: So Ka'b and the people overturned their pots. Then when we were on part of the road, and Ka'b was praying by a fire, a swarm of locusts passed by him, and he took two locusts and killed them, forgetting his ihram. Then he remembered his ihram and threw them away. When we reached Madinah, the people entered upon Umar ؓ and I entered with them. Ka'b said: 'What do you think, O Commander of the Faithful?'—and he related to him the story of the two locusts. He said: 'No harm in that, O Ka'b.' He said: 'Yes.' He said: 'Himyar loves locusts. What did you impose upon yourself?' He said: 'Two dirhams.' He said: 'Two dirhams are better than a hundred locusts. Impose what you imposed upon yourself.'
