أَخْبَرَنِي بُنْدَارٌ، وَأَبُو مُوسَى قَالَا: حَدَّثَنَا ابْنُ أَبِي عَدِيٍّ عَنْ شُعْبَةَ عَنْ سُلَيْمَانَ عَنْ أَبِي ظِبْيَانَ عَنِ ابْنِ عَبَّاسٍ بِمِثْلِهِ مَوْقُوفًا. قَالَ أَبُو بَكْرٍ: هَذَا عِلْمِي هُوَ الصَّحِيحُ بِلَا شَكٍّ. قَالَ أَبُو بَكْرٍ: هَذِهِ اللَّفْظَةُ " وَإِذَا حَجَّ الْأَعْرَابِيُّ " مِنَ الْجِنْسِ الَّذِي كُنْتُ أَقُولُ إِنَّهُ فِي بَعْضِ الْأَوْقَاتِ دُونَ جَمِيعِ الْأَوْقَاتِ، وَهَذِهِ اللَّفْظَةُ إِنْ صَحَّتْ عَنِ النَّبِيِّ - ﷺ فَإِنَّمَا كَانَ هَذَا الْحُكْمُ قَبْلَ فَتْحِ النَّبِيِّ ﷺ مَكَّةَ، فَلَمَّا فَتَحَهَا، وَخَبَّرَ ﷺ أَنَّهُ لَا هِجْرَةَ بَعْدَ الْفَتْحِ اسْتَوَى الْأَعْرَابِيُّ وَالْمُهَاجِرُ فِي الْحَجِّ، فَجَازَ عَنِ الْأَعْرَابِيِّ إِذَا حَجَّ كَمَا يَجُوزُ عَنِ الْمُهَاجِرِ لِسُقُوطِ الْهِجْرَةِ، وَبُطْلَانِهَا بَعْدَ فَتْحِ مَكَّةَ. كذا في طبعة دار الميمان، وفي طبعة المكتب الإسلامي

Translation

✧ Bundar and Abu Musa informed me; they said: Ibn Abi ʿAdi narrated to us, from Shuʿbah, from Sulayman, from Abu Zibyan, from Ibn ʿAbbas, with the like of it, as his own statement. Abu Bakr said: This, according to my knowledge, is the correct version without doubt. Abu Bakr said: This phrase "and if a Bedouin performs Hajj" is of the kind about which I used to say that it applied at some times but not all times. If this phrase is authentically from the Prophet ﷺ, then this ruling was only before the Prophet's ﷺ conquest of Makkah. When he conquered it and informed ﷺ that there is no migration after the conquest, the Bedouin and the emigrant became equal in Hajj, so Hajj performed by a Bedouin is valid just as it is valid for an emigrant, due to the cessation and invalidation of migration after the conquest of Makkah.
