✧ The Guardian

أَخْبَرَنَا ابْنُ خُزَيْمَةَ حَدَّثَنَا عَبْدُ الْأَعْلَى بْنُ وَاصِلِ بْنِ عَبْدِ الْأَعْلَى حَدَّثَنَا يَعْلَى بْنُ عُبَيْدٍ عَنْ يَحْيَى بْنِ سَعِيدٍ الْأَنْصَارِيُّ عَنِ ابْنِ جُرَيْجٍ عَنْ سُلَيْمَانَ بْنِ مُوسَى عَنِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ قَالَتْ قَالَ رَسُولُ اللَّهِ ﷺ

«أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذَنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ مَرَّتَيْنِ وَلَهَا مَا أَعْطَاهَا بِمَا أَصَابَ مِنْهَا فَإِنْ كَانَتْ بَيْنَهُمَا خُصُومَةٌ فَذَاكَ إِلَى السُّلْطَانِ وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»

✧ Any woman married without the permission of her guardian, her marriage is invalid, twice. She may keep what he gave her for what he obtained from her. If there is a dispute between them, then that is for the authority, and the authority is the guardian of one who has no guardian.
